英文合同翻译实践报告一一以《约克大学住宿协议》为例

The Report on the Translation of English Contracts Based on Residential Accommodation Agreement of University of York

摘要

随着中国经济实力加强,对外交流日益频繁,越来越多的人选择前往英国留 学、工作和生活,英文房屋租赁合同的使用也因此越来越广泛,但是大部分中国 人对英国法律完全不了解,也因此英文房屋租赁合同的汉译具有十分重要的意 义,不仅能帮助他们理解合同条款,也能帮助他们更好地履行合同项下规定的权 利与义务。

本报告旨在结合法律翻译的标准以探讨法律合同的翻译难点以及其应对策 略。由于法律文本属于专业性非常高的一类文本,法律翻译则是法律转化与语言 转换同时进行的一项双重活动,因此,本项目执行过程中,笔者由于对专业知识 不了解,会出现用词不准确,用句不规范等问题。为了解决这些问题,笔者采用 了归纳法、文献分析法和案例分析法对文本进行具体地分析,并提出相对应的翻 译策略。

本报告一共分为五章,第一章主要介绍了本报告的研究的背景、内容和意义。 在第二章中,笔者从项目内容与翻译要求和项目现实意义两个方面详细地介绍了 本次翻译项目。第三章主要介绍了翻译项目的流程,主要包括译前准备,翻译进 行阶段,和文本译后阶段。在第四章中,笔者分别从词汇层面和句子层面探讨了 此次翻译过程中遇到的问题,并提出最佳的解决策略。在词汇方面,笔者主要探 讨了情态动词的翻译、词性转换的应用增词法和减词法的应用等问题,而在句子 方面,笔者重点探讨了被动语态的翻译和长句的翻译。在本文的最后,笔者就这 两年的翻译学习进行了深刻的总结,并提出在如今这个高速发展的信息时代,一 名合格的译者不应只具备语言能力,还应具备计算机基本技能、信息检索能力、 CAT工具运用能力、术语能力和译后编辑能力等五项重要的技能。

通过此次翻译实践,笔者认识到在翻译法律文本时,译者最应注意的是要保 持译文的准确、通顺、专业与同一,才能达到翻译的目的。同时,在这个过程中, 不仅笔者的翻译能力有所提高,搜集信息与筛选信息的能力也明显增强。止匕外, 笔者还希望本报告能为合同翻译研究略尽绵薄之力,也为今后合同翻译人员提供 参考。

Abstract

With the development of China’s economy and the ever-increasing communications with foreign countries, a growing number of people choose to go to the UK for studying, working and living, as a result, lease contracts are becoming widely used. As most of Chinese have little knowledge of British law, the translation of English house lease contract is of great significance because it is useful for their understandings of the contract and their performances of the responsibilities and obligations under the contract.

This report aims to explore the difficulty of translation of legal contracts and its corresponding strategies by combining the criterion for legal document translation. As legal text is of strong specialization, and legal translation is a dual activity carried out simultaneously with legal transfer and language transfer, the author had many problems in the translation project, such as informal uses of sentences and inaccurate use of words. Therefore, in order to solve these problems, the author adopts he author uses inductive method, literature analysis method and case analysis method to analyze the text, and proposes the best solution with certain translation skills.

This report is divided into five chapters. The first chapter mainly introduces the background, content and significance of the research of this report. In the second chapter, the author talks about the translation project in detail from aspects of the content, translation requirements and practical significance of the project. In the third chapter, the author describes the general process of the translation project from the pre-translation preparation, translation stage and post-translation stage. In the fourth chapter, the author discusses the problems in the translation process from the lexical level and the sentence level, and proposes the best solution. In terms of vocabulary, the author mainly discusses the translation of modal verbs, the use of conversion, addition and reduction. In terms of sentences, the author focuses on the translation of passive sentences and long sentences. At the end of the report, the author makes a summary of the translation studies in the past two years, and proposes that in today*s fast-developing information age, a qualified translator should not only possess language skills, but also equip himself with the basic computer skills, capabilities of information retrieval, CAT tooling application, terminology and post-editing.

Through the translation practice, the author realizes that the most important thing in legal text translation is to maintain the accuracy, smoothness, professionalism and ii

 

sameness of the translation text so as to achieve the purpose of translation. In the end, not only the author’s translation ability but also the ability to collect information and screen information has been significantly enhanced in the process of translation. In addition, the author hopes that this report will be able to contribute to the contract translation research and provide reference for future contract translators.

1章引言

  • 研究背景

近代中国历史上曾出现过三次“留学潮”,第一次“留学潮”出现在洋务运 动时期,当时清政府为了培养洋务事业人才以巩固封建统治,故派遣一百多位幼 童前往美国与欧洲留学,为中国学生出国留学打开一扇大门。第二次“留学潮” 出现在五四运动时期,那时候人们出国留学的主要目的是为了改变旧观念,寻求 新知识,从而改变国内的混乱局面,找到中国的出路。第三次“留学潮”则出现 在中国的改革开放以后,在邓小平总理的鼓励之下,人们纷纷走出国门,走向世 界,学习各国先进思想与技术。自此以后,中国人的留学热度只增不减。而如今, 随着中国的国力逐渐提升,经济走势越来越好,中国人民越来越富有,出国留学 已经成为各个年龄阶段的学生提升自我的选择之一。而相比其他国家,英语国家 由于教育历史悠长,教育水平高,所以一直是中国留学生的第一选择。但是对于 大部分出国留学的中国学生来说,住宿无疑是最重要但也最令人困扰的问题之 一,因为不论是住学校的宿舍还是在校外租房,学生们都要与房东签订房屋租赁 合同。房屋租赁合同属于法律文本,对普通中国学生而言,这类文本难以理解, 这主要是因为法律文本的专业性比普通文本强得多,而且法律语言在遣词造句方 面都独具一格。具体来说,在用词上,法律文本强调的是词语的使用要具体准确、 质朴简洁、严谨规范,并且具有包容性与概括性(潘庆云,1997)。而在用句方 面,由于法律语言的逻辑结构与表达意义独具特色,因此大多数法律语句都包含 情况、条件、法律主体和法律行为等四个部分,而且句子的逻辑严密,不易理解 (潘庆云,1997) o正是因为法律文本的这些特点,中国留学生们的英语水平即 使很好,如果他们平时很少接触这类文本,也不能完全理解合同的各项条款。由 此可见,英文房屋租赁合同的汉译对中国留学生们来说是非常重要的。

止匕外,随着中国的国际化进程逐渐加快,中国企业不断开始走向世界,在中 国企业与外国企业合作时因翻译不当导致冲突的情况有发生。在这种情况下,国 内的法律翻译研究也开始提上日程,并且已经在法律术语翻译、法律语言特征及 翻译和法律翻译实践等领域取得了一些成果(徐琼;王清然,2017) o比如,2016 年,张法连在《中国翻译》中发表了题为《英美法律术语汉译策略研究》,在该 文中,他详细探讨了法律术语汉译的三个步骤并指出了译者应正视的三种法律语 言现象。除此之外,陈小全也在《中国翻译》上发表论文《论法律翻译的归化与 异化策略》(2016),具体探讨了法律翻译策略,为法律翻译实践做出了贡献。 但是总体而言,国内法律翻译研究尚未成熟,还处于起步阶段(郑子敏,2014),

 

而且没有形成系统的翻译理论和翻译标准。因此,笔者希望通过此次翻译实践能 进一步了解法律文本的特点,并结合国内外现有的研究成果,探索出法律文本的 翻译方法和策略,为国内法律翻译研究做出微薄的贡献。

  • 研究内容

本文选取的材料是《约克大学国际预科学院2018/19学年住宿协议》,该协 议属于房屋租赁合同,其中主要包括住宿确认函、居住条款和条件等几个部分。 全文一共分为五章,第一章主要介绍了本报告的研究背景、研究内容和研究意义。 在第二章中,笔者从项目内容与翻译要求和项目的现实意义两个方面入手,详细 介绍了本次翻译项目。在第三章中,笔者分别从译前准备、翻译进行阶段和译后 阶段等三个阶段描述了整个翻译项目的流程。在翻译之前,笔者从文本形式与内 容分析、格式转换与术语表制作和法律翻译的标准等三个方面为此次翻译项目做 了充足的准备。在翻译进行阶段,笔者遇到了一些较难的词汇,无从下手,因此 笔者特在这一节中探讨了这些词汇的翻译。在译后阶段,笔者对初译稿中犯的错 误进行改正并对译文的语言进行润色,最终使译文达到通顺、同一、准确和专业 的翻译标准。第四章是全文的核心,笔者词汇层面和句子层面探讨了此次翻译过 程中遇到的问题,并提出了最佳的解决策略。在本文的最后,笔者就此次翻译实 践总结了自己的心得与体会,并提出在如今这个高速发展的信息时代,译者不应 只具备语言能力,还应具备计算机基本技能、信息检索能力、CAT工具运用能 力、术语能力和译后编辑能力等五项重要的技能。

  • 研究意义

如上所述,中国人出国留学的热度只增不减,而去英语国家留学的学生占了 绝大部分,主要包括英国、美国、新西兰、澳大利亚等四个国家。所有留学生在 出国后都会面临住宿问题,对于中国留学生而言,一般会有三种住宿方式可供选 择,学校宿舍、校外租房和寄宿家庭。但不论是选择哪种住宿方式,学生都需要 签署英文房屋租赁合同。但是由于中英两国的法律属于两种完全不同的法律体 系,两国在法律制度上的差异非常大,从而中英文法律文本也有很大的差异,具 体在合同中体现为:中文合同篇幅短,对合同双方权利与义务的描述比较模糊; 英文合同篇幅长,详细地说明了合同双方的权利与义务。比如在合同中关于非法 活动这一违约条款,在中文合同中的描述为“不得利用所租房屋进行非法活动”, 而在英文合同中的描述为“不得将住宿用于任何犯罪、不道德或非法活动,包括 但不限于售卖、供应或使用非法物品,储存或处理脏物和卖淫”。在中文合同中, 起草者用了“非法活动”一词概括了可能发生的所有活动,而在英文合同中,起 草者将“非法活动”一词具体化,具体说明了从事哪些活动将构成违约。正是由 于这些差异,很多中国留学生虽然英语水平很高,但是如果他们平时很少接触法 律知识,就很难理解合同中的每一个条款。特别是对于住宿协议这类重要的法律 文件而言,如果他们对字词的理解稍有偏差就会不理解或者误解合同中的条款, 就可能会导致严重违约或被取消住宿等严重后果。因此,对中国留学生而言,英 文房屋租赁合同的汉译是十分必要的,翻译能帮助他们理解合同中列出的所有条 款,从而减少违约的风险。

 

2章翻译项目介绍

  • 项目内容与翻译要求

本次翻译材料的原文为《约克大学国际预科学院2018/19学年住宿协议》, 出自笔者在2018年4月到9月于上海一家留学服务咨询公司实习时参与的一个 翻译项目。此次项目的主要内容是翻译某学生申请约克大学的课程与宿舍的材 料,主要包括学生的住宿协议、申请表格、成绩单和校方回执信等。学生们在申 请学校到入学期间会签署很多法律文件,但是由于他们对法律知识不了解,所以 要准确无误地理解这些文件还有一定的困难。因此,笔者受学生委托将上述文本 翻译为中文。在这些文本中,住宿协议对专业性的要求相对而言比较高,对笔者 而言具有一定的挑战性,因此在内容上符合毕业论文的要求。止匕外,随着国内出 国留学或工作的人不断增多,住宿协议的应用也更为广泛,其翻译文本的使用频 率便随之增加,所以,从翻译文本的意义上来说,笔者以住宿协议作为研究材料 也是十分合适的。再者,住宿协议的字数一共为15000字,长度适中,在篇幅上 也非常适合作为本文的研究对象。而就项目的翻译要求而言,由于本项目的大部 分文本属于法律文本,因此,客户要求译文不仅要达到普通文本的翻译要求,在 法律文本的部分,客户还要求译文达到法律文本的翻译标准,即通顺、同一、准 确和规范。

  • 项目现实意义

由于笔者实习的公司是一家出国留学咨询服务公司,该公司的主要业务是为 有意向出国的学生提供欧美等英语国家的留学咨询服务,每年有两百多人在公司 帮助下成功前往欧美各大高效留学,其中前往英国留学的人数占比高达百分之七 十。而所有前往英国留学的学生都会有租房的需求,都需签订住宿协议,而英国 大部分学校的住宿协议在内容与形式上都大同小异。因此,此次翻译项目对于其 他学校的学生来说具有重要的参考价值。

止匕外,在翻译项目执行的过程中,笔者虽然遇到了许多困难与问题,但是最 后经过自身不断地探索,问题都得以圆满解决。在这一过程中,笔者不仅仅学习 到了翻译技巧和法律知识,更重要的是,笔者在解决问题和处理问题的能力得以 方面得到了提高。其次,在翻译过程前后,笔者对于合同的结构和内容都非常了 解,而这些知识也能运用到日常生活中,为今后的生活提供便利。

3章翻译项目流程

  • 译前准备
    • 文本特点与内容分析

首先,从本文内容来看,此次项目翻译材料是英国约克大学与学生签订的一 份房屋租赁协议,该协议中包括约首、约尾和基本条款等三个部分。约首部分详 细说明了合同名称以及出租人与承租人的具体信息,约尾部分主要包括了证人和 双方当事人签字的内容与日期,基本条款中起草者就合同双方的权力与义务进行 了详细地说明。

其次,从文本特点来看,本文属于法律文本,法律文本的专业性非常强,因 此,法律文本的翻译相较于普通文本而言更难。正如卢敏教授所言,法律文本的 翻译是法律转化(legal transfer)和语言转换(language transfer)同时进行的双 重活动(double operation) (2008: 45)。如果译者在翻译这类文本之前对文本 的特点与内容不熟悉,就很容易造成译文的语言和风格不符合法律规范。因此, 为充分了解本文特点,笔者查找了大量文献并得知,通常法律文本分为两大类: 第一类是法律文本是以规定性为主要功能的文本;第二类文本时是具有规定性和 描写性成分的文本(李克兴、张新红,2006: 11)。第一类文本通常包括法律法 规、法典与合同等,这类文本具有规范人的行为,社会成员的责任和义务等功能。 本文材料就属于第一类文本,该文本以法律语言为主,但其中穿插着通用语言, 而且该文本在词汇和句子的运用上也具有独特性。在词汇层面,本合同体现为: 一、大量使用由法语衍变而来的词汇,如”action” , “agreement” , “claim”, “payment”, “obligation”等;二、大量使用专业术语,如:”Courtproceedings”, uGuarantor Declaration,v “validity”等;三、使用正式程度较高的词汇,如: “prior to(取代 before)”, ” subsequent(取代 after) , arise from(取代 result from)”; 四、使用意思含糊的词语,如”later”, “similar” , “and/or”, “due”, “reasonable” 等。在句子层面,本合同主要表现为:一、多用名词性结构。法律英语语句正规, 表述客观,没有任何主观色彩,所以名词化结构在法律英语中的使用频率较高, 而且名词性结构的组合方式非常多,涵盖的信息量很大,形式十分简明,颇受英 文合同草拟者的青睐(肖凡,2008) o 如:”we will charge you with the reasonable cost of having to force entry and repairing any associated damage.二、使用独 具法律含义的句式。法律英语中的一些句式和短语很少出现在其他文本或日常生 活中,这也是法律英语具有独特性的原因之一。如大量使用含有“Subject to”,

“where” , “otherwise”等词或词组的句式。三、多用祈使句。法律合同的主 要功能是规范双方的权利与义务,具有客观性与严肃性,因此英文法律合同中多 使用祈使句,如”Do not sign this Agreement unless you intend to be legally bound by its terms”。四,大量使用被动句。相对于主动句而言,被动句主观性较弱,而 且被动句的主要特点是强调受事者和弱化施事者,因此在法律合同中,作者们通 常更喜欢使用被动句,从而突出法律语言客观性与权威性的特点。

  • 格式转换与术语表制作

接到住宿协议的翻译任务以后,笔者首先对文本进行格式转换,该文本最初 为PDF格式,但考虑到翻译的便捷性,笔者将PDF格式转换为WORD格式, 随后对文本进行校对,避免后期造成信息的漏译。其次,由于法律类文本具有很 强的专业性,因此制作术语表是法律翻译过程中是不可或缺的。在术语表的制作 中,笔者首先采用在线的词频统计系统统计出现频率较高的词语,将其列为部分 术语。止匕外,为了方便学生理解,校方在协议中将部分术语以首字母大写的形式 标记出,因此,笔者将这两者结合,形成了最终的术语表,一共209个。在术语 的翻译过程中,笔者主要参考了相对权威的两本纸质版词典《英汉法律词典》和 《元照英美法词典》以及线上数据库,如:TMXmall数据库和CNKI数据库。

  • 法律翻译的标准

我们谈到翻译,一定会提到翻译标准。翻译标准作为翻译活动的准绳,是衡 量翻译质量好坏的标杆,也是译者们追逐的终极目标。古今中外,学者们对于翻 译标准总有着不同的看法,比如说,严复在其著作《天演论》中提出“信、达、 雅”的翻译标准;林语堂则在“信、达、雅”的基础上提出了忠实、通顺和美三 个标准;许渊冲提出了诗歌翻译的“三美论”;尤金•奈达提出了翻译的功能对 等论。学者们提出的翻译标准虽然各有所长,各有侧重,但都不完全适合法律文 本的翻译。于是,在此基础上,董晓波提出,法律翻译不仅要达到普通翻译的标 准,还应该达到准确、规范、同一、通顺等四个标准(董晓波,2011: 19)。

(1)准确

准确是法律翻译的第一标准。在法律翻译中,准确指的是译文不但要字面上 忠实于原文,而且保持原文中上下意思的连贯与呼应。

在法律翻译中,影响语言准确性的本质原因在于两种法律语言存在差异,这 些差异主要包括法律词汇的差异、行文格式上的差异和表述结构的差异。要克服 这些差异,译者必须对两种语言背后的法律文化非常了解。在翻译时,如果译者 在目的语中完全找不到与原语相对应的词语时,则需要意译或照着原文的形式翻 译,这样读者才能完全理解原文表达的含义。如:

例 1 Defective Premises Act 1972

初译:1972年瑕疵房屋法

改译:1972年缺陷前提法

分析:上例中的uDefective Premises Act 1972” 一词,笔者最开始在各大网站

和数据库中都未找到这个词的准确译法,所以笔者在初译中将其译为“1972年 瑕疵房屋法”。但是在审校时笔者发现这种译法完全没有表达出原文的意思,而 且中文读者也无法理解。后来经笔者查找,“Defective Premises Act 1972” 一词 在英文版维基百科网站中的表述为”The Defective Premises Act 1972 (c. 35) covers landlords’ and builders’ liability for poorly constructed and poorly maintained buildings, along with any injuries that may result”, 意思是 uDefective Premises Act 1972”指的是“房东和建筑商应对建造不良和维护不善的建筑物以及其造成的损 害负责”,而且,“Premises” 一词的本意就是“前提”,而初译中,译者并没 有将这个词翻译出来,但是在审校过程时,笔者发现直接将该词的字面意思翻译 出来更贴近该词的本意,即翻译为“1972年缺陷前提法”。

从上例中,我们得知,由于不同国家的法律制度有所差异,我们在法律文本 的英汉互译中就会经常遇到类似“Defective Premises Act 1972”这种在译入语中 没有对等词的词语。对于这类词语的翻译,笔者认为应该坚持两条原则,第一, 如果译语中有意思相近的词语,可以以该词为参考进行翻译;第二,如果完全找 不到对等或者意思相近的词语,就要尽量贴近原文,将原文的意思表达到位,从 而达到译文的准确性要求。

例 2 Bank Address

初译:银行地址

改译:开户行地址

分析:例2中,“bank address”这个词组在字面上看似非常简单,表面意思就 是“银行地址”,但是结合上下文,笔者将其译为“开户行地址”。这样翻译是 因为”bank address” 一词出现的位置比较特殊,它位于在本合同住宿支付信息 一栏中。而且据笔者了解,国内向国外转账需要对方账户开户行名称和地址,否 则无法成功转账,所以这里的“银行”指的不是普通的银行,而是约克大学银行 账户的开户行。如果将其翻译为普通的银行,则不够准确,还可能会让读者误解, 从而无法达到翻译的目的。因此,对于这类词语,只翻译词语的字面意思是不准 确的,译者应该合理分析上下文,挖出词语背后更深层次的意思,才能实现翻译 的准确性。

(2)规范

规范指的是法律语言文本格式和用词上的规范,不同形式的法律文本均有不 同的特点与要求。合同属于法律性公文,所以在翻译此类文本时应使用学术界约
定俗成公文词语,如“上述”,“下述”,“以此”等等,使用这样的词语会译 文的结构会更严谨,逻辑会更严密。其次,专业性词汇的正确翻译也是衡量译文 是否规范的重要标准。比如:

以上10个词语都是专业性词语,这些词语中的大部分翻译都是译者们在多 次的翻译实践中总结出来的约定俗成的译文。在翻译“the International Pathway College” 一词时,笔者查到“pathway” 一词的本意为“路,途径”,因此最开 始笔者认为这个词指的是约克大学下属的一个学院“国际路桥学院”,但后来笔 者咨询了客户本人并同时在互联网上找到这个该学院中文网站,才确定该翻译为 “国际预科学院”。“预科”指的是“大学前的预备教育”,这种教育模式是由 国外传入中国本土的,也就是说,中文中最初是没有“预科”这一概念的。由此 可见,“the International Pathway College”的翻译是译者们在长期的翻译实践中 总结出来的,已经成为一种约定俗成的翻译,并且已经为大众所接受。因此,在 翻译这类已有固定译法的词语时,译者在只需按照已有的译法翻译即可,这样不 仅省时,而且译文的准确度和专业度也更高,读者也更容易接受。

在文学作品的翻译中,译者用修饰性词语或者近义词来表达相同的概念是完 全可行的,而且读者会觉得该作品生动有趣,语言丰富,可读性强。相反,如果 相同的词语总是重复出现,会令读者觉得作品枯燥乏味。但是,在法律翻译中, 即便是用意思相近甚至完全相同的词语来表达同一种法律概念也是不可取的,因 为法律文本翻译追求的目标就是译文前后要具有同一性。同一性指的是始终用相 同的词语来表达某一法律概念,并且从始至终要保持一致,如果译者用词过于丰 富则会模糊法律概念,进而无法达到实现该文本的法律功能。如本文材料中的 “tenant” 一词在文中出现5次,共有“租户”,“房客”,“承租人”“租客” 等几种译法,虽然这些译法都是可行的,但笔者只选择了 “租客”这一种翻译, 且前后都保持一致,这样读者才能更清楚自己的权利与义务,从而避免因翻译不 当而造成的法律纠纷。再比如,本文中的“deposit”一词,笔者搜到共有“定金”, “押金”和“保证金”等三种译法,这三种说法都表示“deposit”是一方或双方 当事人为了保证履行合同规定的责任而留存于对方或第三方的金钱,因此都可作 为“deposit”的翻译。如果在翻译时,译者同时将以上三种译法都采纳,读者可 能会认为这是三笔不同的钱。这样的话,译文不单不能表达出原文的实际意思, 还可能误导读者,导致读者拒绝签署协议。因此,在翻译时,笔者必须遵循法律 术语同一性的原则,将全文中所有的“deposit”都翻译为保证金,从而实现上下 文的同一性。

(4)通顺

通顺最早是林语堂先生在其著名译著《翻译论》中提出的翻译标准,这一标 准在法律本文的翻译中同样适用。而在法律翻译中,要做到通顺的关键是译文的 遣词造句要正确,语言表达要符合译语的表达习惯(张伟华,2014)。句子中的 各个成分要准确表达,而且各个成分要以正确的顺序排列,句与句之间要紧密联 系,相互照应。例如:

例 3 We will comply with the Data Protection Act 1998 as amended from time to time.

初译:我方将遵守不时修订的《1988年数据保护法》。

改译:我方将遵守《1998年数据保护法》(以不时修订的版本为准)o

分析:在上例中,就语法来看,黑体部分“as amended from time to time”是”Data Protection Act”的后置定语,翻译为修饰语“不时修订的”,而在汉语中,定语 一般不习惯置于被修饰词后,所以在初译中,笔者根据自己的翻译习惯直接将其 置于《1988年数据保护法》这一名词之前。但是,在后来的审校过程中,笔者 发现这句译文在语意上表达不清晰、不明确,而且读起来不通顺,不顺口,不符 合中文的表达习惯。因此,笔者将“不时修订的”这一定语放在被修饰词《1988 年数据保护法》后,并用括号括起来,作为该词的注释,其主要作用是强调此项 法案以最新版本为准。

总的来说,法律翻译的标准可以概括为准确、规范、同一和通顺四个词。准 确和通顺作为法律翻译最基本的要求,是实现翻译目的的奠基石。规范和同一体 现了法律语言的特殊风格。这几个标准之间相互依存,缺一不可。因此,在翻译 法律文本时,译者应极力实现译文的准确、规范、同一和通顺。

  • 翻译进行阶段

笔者于7月13日接到翻译任务,从初稿、改译稿到终稿花费的时间大约一 个月,全部由本人独立完成。在这一翻译过程中,笔者遇到最多的问题就是近义 词、专业词汇和陌生词汇等词汇翻译问题。例如:

例 4 You must bring the original, signed codv of this Agreement with you when you travel to the U.K. and present it to Pathway College staff during registration.

初译:原件;复印件

改译:正本;副本

分析:“Original”和“Copy”这两个词在原文中出现的概率非常高,笔者在有 道词典、必应词典和朗文词典中查询到这两个词有“正本;副本”,“原件;复 印件”两种意思,因此笔者无从选择,而且我国司法实践中,由于分类标准杂乱, 即便是法律从业者也将这几种概念混为一谈,正本与原件划上等号,副本与复印 件相同。后来通过查询文献,笔者发现,在中文中,正本与原件,副本与复印件 其实并非同一概念。正本是发给主受件人保存或使用的,而原件一般是保留在制 作人手中或存档备查。副本是按照正本制作并给主受件人以外的其他人使用的 (全亮,2012)。而复印件则是以原件为原版复制出来的复印本。从例4的前后 文可以明显看出,“original”指的是制作人发给受件人使用的文件,因此应译 为“正本”,而相对应的“copy”应翻译为“副本”。

从本例我们可知,正本和原件,副本与复印件的意思虽然非常相近,但是法 律语言非常严谨且严肃,在翻译时碰到这种意思相近的词语时,必须要弄清楚该 词语对应的中文意思,并根据不同的语境进行分析,再确认最终的译文,切不可 胡乱猜测,否则可能会误导读者,造成法律纠纷。

  • 文本译后阶段

初译稿完成后,译者还需对译文进行审校与润色。因为初译稿完成后,译文 还可能会存在许多错误,比如说拼写错误、句子的逻辑关系错误、术语不统一、 术语翻译错误,以及译文的框架结构与原文不一致等错误。因此,笔者在经过初

译的冷却期之后,抛开原文,对译文进行审校与润色,以达到客户的翻译要求。 如:

例 5 We confirm to you that ©when exercising any of our rights to inspect, enter, repair or otherwise manage the Accommodation and the Residence in accordance with the terms of this Agreement  we will do so in accordance with our obligations and duties to you under any relevant safeguarding laws and regulations applicable under English Law.

初译:我们保证,我们将根据英国法律适用的任何相关保护法律与法规,按照 我们的责任与义务,根据本协议条款行使检查、访问、修理或其其他方 式管理住宿和住宅的权利。

改译:①我方对您保证,②我方在根据本协议的条款行使检杳、进入、修理或 以其他方式管理住宿和住所的权利的同时,③亦将根据适用于英国法律 的所有相关保障法律法规来任使我方的权利和义务。

分析:从语法的角度来看,例5中句子的主干部分为”we confirm that+宾语从句”, 而其中的宾语从句又由“when引导的状语从句+主句”的形式构成。从初译的译 文看,显然译者将“under any relevant safeguarding laws…”这一句看作了整个宾 语从句的状语,而实际上这句话只是“we will do so…”这句话中的状语成分, 正由于译者在原文的理解上出现错误,所以初译在句意的表述上就出现了明显的 错误,而且句子结构也十分混乱。由此可见,如果译者在翻译之前找不出原文句 子的主干部分,翻译出的译文就会不通顺,层次也不分明,原文的信息就得不到 有效的传递。所以在译后的审校阶段十分重要,在初译的冷却期过后,笔者仔细 分析原文,将译文的语序按照原文的句子结构进行调整,将宾语从句中主从复合 句翻译为两个并列句,结构“在……的同时,亦将……”,这样一来,句子结构 更清晰,层次更分明,可读性增强,符合翻译要求。

从上例我们可知,翻译过程中审校与修改这一步至关重要。即便是资深译者 在初译后重新阅读自己的译文时也能发现错误。因此,在审校过程中,我们需要 梳理初译文中的每一个词语和句子的翻译,要保证词语翻译准确,句子的逻辑结 构无误,句与句之间衔接紧密,全文的结构符合规范。

 

4章案例分析

  • 词汇层面的翻译难点与应对策略

正如上文所述,本租赁合同中含有大量法律专业词汇与住宿类词汇,这 些词汇给翻译带来不少困难。因此,笔者将对词汇层面的翻译难点进行具体 分析,并且提出相应的翻译策略。

  • 情态动词”shall”与”must”的处理

情态动词作为英语动词的重要组成部分,其在法律或合同的起草中的主 要作用是修饰某一个条款,使之正确反映起草者或指定者对条款的表述可能 含义的判断,或反应我们对自己所说所写内容正确与否的判断(Randolph Quirk, 1985: 219)。在法律英语中,情态动词的使用频率也非常高,常见 的情态动词有“shall”,“must”与“may”。在本次翻译项目中,“shall” 与“must”出现的频率相对而言比较高,接下来,我们就对这两个词的用法 与译法进行讨论。

“shall”是法律文本中不可代替的一个词,尤其在英文合同中, “shall”是情态动词中使用频率最高的一个词。“shall”在法律英语中的作 用相当于”have to” , “must”, “beto(do)”, ube required to v (Fung and Waston-Brown, 1994: 27)。但是对于“shall”的中文翻译,国内法律翻 译界却尚未得出准确的结论。常见的几种翻译有“须”,“要”,“应”, “可”,或者不译。例如:

例 6 The Advance Payment shall be treated as follows: £750 ©shall be offset against the first instalment of the Accommodation Fee ; and £250 ©shall be held as the Deposit for the performance of your obligations under this Agreement.

初译:预付款①应按如下方式处理:750英镑②亘用于抵扣第一次分期付款

额,250英镑③亘作为您履行本协议义务的保证金。

分析:在本合同中,”shall” 一共出现14次,上述例句中就有出现3处, 在上例中,根据上下文,原文表达的意思是“学生应缴纳预付款1000英镑, 其中750英镑是第一次分期付款额,250英镑是保证金”,这是对学生缴纳 的1000英镑预付款的一项说明。而在初译中,笔者将第一个“shall”翻译 为“应”,将后两个“shall”翻译为“可”。如果放在普通的语言中,这两 种译法都没有任何问题,但是从这两个词的法律意义来看,“可”在中文中 表示的是一种许可或选择,“应”表示一种强制性语气。而且从大量法律条 文来看,“shall”表达的是一种强制性规定。而从上例表达的语意来看,预 付款的分配安排是强制性的,后两句只是对预付款项安排的一个说明,学生 无权选择性的分配。因此,从法律翻译的准确性来说,译者将第二个和第三 个“shall”翻译成“可”是不恰当的,应该译为“应”或者直接忽略不翻译, 这样的话,译文会更简洁,而且也不会影响句意的表达,符合法律翻译的标 准。另外,通常在法律文本英译中,表示“可”或者“可以”更恰当的词语 应该是“may”或者其他形式。而且在《基本法》的英文版中,“may” 一 词的出现频率为75次,其中有62处是用“可”来翻译的(李克兴、张新红, 2005: 66),由此可见“可”的最佳译文也应该是“may”。

从上文可知,“shall” 一词翻译为“可”是不恰当的,除此之外,“shall” 翻译为“将”和“要”也不合适。首先,如果法律文本中的“shall ”被翻 译为“将”,我们认为这是一种误译。因为“将” 一词在汉语中,表示的是 “将要;将至”的意思,而“shall”在条件句中虽然有表示将来的意思,但 是它的主要作用是表示命令,义务和权利。因此,从法律翻译标准中的准确 性来说,如果将“shall”翻译为“将”就会使整个句子失去原有的功能,丧 失意义。其次,将“shall”译为“要”也是不恰当的。“要” 一词虽然在中 文表示强迫和威胁,但是“要”的口语化程度很高,因此在严肃、正式的法 律文本中,将“shall”翻译成“要”是不可行的,不符合法律翻译中的规范 性标准。

改译:预付款应按如下方式处理:750英镑用于抵扣第一次分期付款额,250 英镑作为您履行本协议义务的保证金。

例 7 We shall be entitled to deduct and/or retain from the Deposit.

译文:我方有权扣除保证金中的任意金额。

分析:例7中,我们可以看到笔者在翻译时将“shall”直接省略不翻译。一 般来说,“shall”在两种情况下不翻译,第一种情况是在具有较长时效的 一般性法律条文中,如《基本法》中”All Hongkong residents shall be equal before the law”,译文为“香港居民在法律面前人人平等”,这句条文的表 达方式和普通英语中的自然规律一样,用的是一般现在时,表示这一条款的 时效性非常长。在这句话的中文译文中,译者虽然没有将“shall”翻译成具 有强制性动词,但是这句话依然有制约作用。第二种不译的情况是在法律或 者普通的合约条文中,“shall”后面的动词本身就能表达权利、义务或责任, 以及主句结构为”shall be projective(表语)“。例7就属于第二种,在该句 子短语“be entitled to”的意思为“有权、有……资格”,如果在“有权” 前加上“应”或者“须”,则有画蛇添足之意,不符合法律语言简洁明确的 要求。因此,这里笔者选择不翻译。

“shall”一词除了上述几种翻译方法外,还能翻译为“须”,比如:“The date of the Bill of Lading shall be accepted as a conclusive evidence of the date of shipment (译文:提货单的日期须被承认为付运日期的确实证据)”(薛 华业,1993: 12) o这里的“须”带有强制性的意味,但是又要比“必须” 的强制性弱。所以我们可以总结出这样一条规律,从强制性语气的强弱来看, “必须”强制性程度最高,其次是“须”,然后是“应”。

综上所述,在法律文本中,如果“shall”出现在约束有关各方的合约条 文中,一般可以翻译为”应”或者不翻译,如果出现在约束一方的合约条文 中,可以翻译为“须”,但是不论出现在何种情况下,都不能翻译为“可”, “要”和“将”。因此,笔者认为具体采用哪种翻译不能单纯凭借自身的经 验或直接,而要根据不同的语境下强制性的强弱来决定。

例 8 A minimum of £1,000 (Holding Fee) must be paid immediately to secure the room. The remainder of Instalment 1 must be paid before or upon registration at the Pathway College.

译文:为保证房间预订成功,您必须立即支付至少1000英镑(保证金)。 第一期分期付款余下金额您必须在预科学院注册前或注册时支付。 分析:例8中,第一句话的意思是“学生想要成功预订房间的前提条件是必 须要支付1000英镑的保证金,并且没有任何商量的余地”。第二句的意思 是“学生如果没有在到预科学院注册时或注册前支付剩余的金额,就无法入 住”。这两句话都是表示强制性,不带任何商量的口吻。而“必须” 一词在 中文中表示事理或者情理上的必要,即“一定要的意思”。因此,为了使译 文具有准确性和同一性,笔者将这两处的“must”都翻译为“必须”。“must” 一词是英语中强制性最高,语气最强的情态动词。而在中译英中,当“shall” 作为情态动词与第三人称连用并且表示“命令、义务和责任”时,也可以翻 译为“必须”。但是,法律起草者们和法律翻译者们在翻译实践中常常将 “must”与“必须”相对应,这已经成为法律翻译界一条约定俗称的规律。

因此,我们在翻译中文法律文本中“必须”一词时,最好将其翻译为“must” 以忠实、准确的表达出原文的含义。

  • 词性的转换

汉语与英语在词的分类上大致相同,而且词类的语法功能也大致相同, 但是在翻译实践中,英汉两种语言在词类上并不能完全对应(卢敏,2008: 76)。在这种情况下,词性转换的作用就得以发挥,词性转换几乎可以在所 有词类中产生。而且,著名翻译家孙致礼先生也曾说,在忠实原文的情况下, 对英汉两种语言的词性进行适当的调整与转换可以突破原文词法格局,化阻 滞为通达(孙致礼,2003: 81) o因此,在本次翻译项目中,为了实现译文 的通顺连贯,达到翻译的目的,笔者也采用了词性转换的翻译方法。如:

例 9 Any reasonable removal and storage charges and or disposal costs incurred by us in relation to items of property and belongings left by you in the Accommodation at the end of the Period of Residence.

译文:在您居住结束时,对您住宿内财产或财务进行搬运、储存和处理而产 生的合理费用。

分析:名词在现代英语中的使用范围非常广,它可以在句子中充当主语、定 语、宾语、表语、宾语补足语等不同的成分。但在汉语中,名词的使用频率 远远低于动词,正因为英汉两种语言在用词上具有不同的倾向性,为使译文 通顺流畅,清晰准确,在英译汉时,译者经常将名词转译为动词。比如,在 例 9 中,“removal” , “storage”和”disposal”分别都由动词“remove”, “store”以及“dispose”派生而来,而汉语是一词多类,并无派生现象(邹 彤,2014)。但为了让译文符合汉语的表达习惯和语法规则,笔者在翻译的 时候就采用了词性转换,将三个名词分别翻译为三个动词将这三个词分别翻 译为动词“搬运”,“储存”和“处理”,而且这种译法也非常符合法律翻 译中的准确和通顺两个标准。

从上文中,笔者总结出一条规律,即在翻译这类由动词派生出的名词时, 不应直接将其翻译为名词,而应先找出其动词形式,然后再相应地恢复其动 词词性,这样翻译更符合法律语言明确性(Clarity)与简洁性(Simplicity) 的特点(陶博,2004: 53)0

例 10 Failure by you to comply with this clause by refusing to vacate will be considered a serious breach of this Agreement.

译文:如果您耒遵守本条款,拒绝搬离,将被视为严重违反本协议。

分析:英语是曲折语言,其动词的形态变化多端,使用范围也因此受到非常 大的限制,所以,英语相对而言更喜欢用名词或者名词词组。而汉语是分析 性语言,汉语中没有词的曲折变化,因此汉语更倾向于使用动词或动词词组 (冯巧珍,2016)。正是由于英汉两种语言在词性的选择上有所差异,例 10中,笔者将名词“failure”译为副词“未”,将名词词语“a serious breach” 译为动词词组“严重违反”。再者,“failure”和“a serious breach”这两 个词给人的感觉是静态的,正如前文所说,在法律文本中,被动语态的使用 让人觉得没有人情味,笔者认为在合同中名词结构使用过多也会让合同起草 者与读者产生距离感,从而使读者在情感上拒绝阅读该文本。所以,译者在 这里将这两个词译为动词,一方面使之符合中文的习惯表达,另一方面,可 以拉近读者与文本的距离,让读者能更好地理解合同中的条款,以避免因误 解造成的纠纷。

综上所述,在法律翻译中,词性转换是没有特定规律可循的,但是在必 要时,译者可以在忠实原文的基础上,适当地在英汉两种语言间进行词性转 换。但是正如兰盖克(Langacker)所言,名词、动词、形容词、副词等语 言范畴不仅仅只有形式属性的语法范畴,而且还承载意义(转引自叶子南:

2007) o 比如说”the collapse of the bridge”和 uthe bridge of collapse v ,这 两个句子在语意上虽然是一样的,但是两者呈现出的画面,给读者的感觉确 是一个静一个动。动态的事物能在感官上触动读者,而静态的事物在大脑中 存在的时间更长。因此,这也启示我们,词性转换并不是必要的,在转换之 前要仔细思考原作者想突出的是什么,而读者想看到的又是什么。只有了解 这两点,词汇转换才能起到真正的作用。

  • 增词法与减词法的应用

由于英汉两种语言根植于不同的社会和文化背景,从而导致两种语言在 句法结构上产生巨大差异,因此译者常常会在翻译的过程中运用增词法与见 减词法。增词法指的是在翻译过程中增添单词和句子,从而使译文在语法结 构和语言形式上符合译语的表达习惯,进而通顺连贯地表达原文的内容,最 终实现翻译目的(杨贤玉,2010: 141) o减词法,从字面意思可知,指的 是在翻译过程中,特意减去一些多余累赘的词语。在翻译过程中,减译法的 使用能让译文行文更加简洁,更符合译语读者的审美标准。在法律翻译中, 译者同样需要用到增译法和减译法以达到准确和通顺的翻译标准。比如:

例 11 If you wish to cancel your Accommodation after you have signed this

Agreement, you will be liable to pay the minimum of the £750 cancellation fee but may be liable to pay the full Accommodation Fee depending upon whether or not we are able to relet your Accommodation.

译文:如您想在签署本协议后取消住宿,则应支付至少750英镑的取消费, 但也可能要支付全部住宿费,具体费用取决于我方是能否成功将您的 住宿转租给他人。

分析:例11中,笔者在译文中增添了 “具体费用”,“成功”和“他人” 等词。那么为什么要在句子中增添这几个词语呢?下面笔者就这三处增译进 行具体的分析。首先,从语法的角度来看,上例中原文采用的是法律英语中 常见的句式“if引导的条件状语从句+主句”,翻译成中文为“如果……怎 么样”。而该句的主句又由两个并列分句“you will be liable to…”和”… but may be liable to…”构成,在第二个分句中又有一个定语从句”depending upon…”用来修饰名词词组“the full Accommodation Fee “。理清句子主干 以后,笔者首先将”…but may be liable to…”这个分句中的定语从句与主句 切分,将英语中的主从复合句变成汉语中两个并列的分句,但是这样一来, 第二个分句“取决于…”就明显缺少主语,因此,为了让译文的表达更完 整,译者在这句话中增添主语“具体费用”。

其次,从句意来看,句子中描述了取消住宿的两种结果,一个是支付 750英镑的取消费,另一个是支付全部住宿费,也就是说,需要支付的费用 金额是不确定的,因此在这里增添“具体费用”这一模糊性词语非常符合原 文的语意。综上所述,此处的增译不论是从语法还是语意的角度而言都是非 常成功的。而句末的两处增译“成功”和“他人”则让整个句子表意更完整 清晰,而且译文的可读性也非常强。从上例中对增译法的应用我们可以得知, 恰当的增译能让整个句子的表意更加完整,但是如果我们在不该增译的地方 增译或增添了不恰当的词语则有“画蛇添足”之意,反而影响译文的质量。 因此,我们在使用增译法时,一定要仔细推敲原文与译文,分析增译是否有 必要,增译的词语是否符合上下文的语境。

例 12 If you move into the Accommodation without having Accepted the Agreement you will be deemed as having Accepted the Agreement by vour actions.

译文:如您在未接受协议的情况下进入宿舍,将被视作接受协议。

分析:例12的结构与上例一样,为“If引导的条件状语从句+主句”。如果 译者将这句话按照原文一字不落地翻译,译文则为“如果您在未接受协议的 情况下进入宿舍,您的行为将被视作接受协议”。从中文的语法角度看,这 句话显然是个语义重复的病句,因为句子中“您的行为”指的就是“在未接 受协议的情况下进入宿舍”的这个行为。此外,从语意的角度而言,将“by your actions” 一词翻译出来似乎是多此一举,因为这里即便不翻译,读者也 知道“action”指的就是前文,翻译出来反而会使译文看起来十分啰嗦,语 意不明。因此,译者直接省译了 “by your action”,这样译文的表意才更清 晰而且可读性也更强。

从上述两例,我们可知,增译法和减译法能在词汇、句法和逻辑方面有 效地帮助译者处理法律文本中的句子,使之符合目的语的表达习惯,从而达 到法律翻译的准确和通顺的标准。但是,在运用这两种方法时,译者还应注 意两点,一是不能过度使用增译或减译,从而降低翻译译文的效果(许艺萍, 2016) o二是,不能盲目使用增译或减译,在使用这两种翻译方法时,译者 始终要牢记法律翻译的八字标准,即准确、规范、通顺、同一。

  • 句子层面的翻译难点与处理方式

法律合同的撰写中,作者偏爱被动句,长句和祈使句,而中文的合同中, 被动句和长句的出现频率很低,于是这就给法律合同的英译带来一定的困 难。接下来,笔者将对此次翻译实践中比较典型的长句和被动句进行分析, 并探讨相对应的翻译策略,为合同翻译研究献言建策。

  • 被动语态的处理

被动语态作为英语动词的一种特殊形式,其主要的功能是说明句子中主 语和谓语两个成分之间的关系。除此之外,被动语态在英语中还具有十分重 要的语用功能,其中最主要的功能就是强调受事者,突出或者弱化施事者(胡 壮麟,2005: 97)。因此被动语态在法律英语中得到了广泛地应用,原因有 两点,其一,相对主动语态而言,被动语态没有那么多主观色彩,符合法律 语言权威性和严肃性的特点;其二,被动语态突出论证对象,引人注目;其 三,被动语态更简洁、精炼。因此,在法律英语中,被动语态的大量使用不 但能使法律英语更加权威客观、精密准确,更能根据不同的需要强调或隐藏 动作的主体,从而扩大法律法规的使用范围(文吉青,2015)。但是在法律 汉语中,被动式的用途比主动式窄的多,而且它的特殊任务无法用主动式替 代,因为被动式描述的东西对主语式而言都是不如意或不期望的事,如受骗, 受害等等(王力,1985: 108)。所以在翻译的时候,被动语态常常给译者 增加不少困难。在此次合同中也存在大量的被动句,接下来将就这些被动句 进行讨论,并总结英文合同汉译中被动语态的常用方法与策略。例如:

例 13 You are not guaranteed the same Room will be allocated or for the same

Accommodation Fees.

译文:我方不保证您能分配到同样的房间,或收取相同的住宿费用。

分析:例13中有两个被动式,分另U为”are not guaranteed”和”be allocatedv 0 如果将这两个被动式分别翻译为“您不被保证”,“房间将被分配”则显得 十分啰嗦,而且也不符合中文的语言习惯,不符合法律翻译准确和通顺的原 则。从本句句意来看,这句话的意思是“我方虽然会尽量为您分配与之前一 样的房间,但是并不保证您百分百能分到同样的房间”,而且从语法的角度 来看,这句话中运用了被动式,主要目的就是弱化主语“you”,强调“the same room,, ,因此笔者没有将原文中的被动句翻译为中文的被动句,而是 将第一个被动变为主动,添加主语“我方”,将原文中的“you”变为宾语, 既能达到弱化宾语的效果,又能保持法律语言的简洁性和清晰性。至于原文 中第二个被动式“be allocated”的处理,笔者直接省略了 “被”字,将其译 为“分配”,这是因为“分配” 一词在中文中既有主动含义也有被动含义, 所以,即使笔者没有用中文的“被”字来表示被动,但是这种译法表达出的 效果还是与英文的被动式一样,我们将这种保留被动式但省略“被”字的译 法成为“有被不用被”。

在英文合同中,起草者们特别偏爱被动式,如同本文。他们之所以喜欢 用被动式是因为法律文本具有权威性和强制性的特点,采用被动式可以避免 出现表示作者主观看法的词语(杜淑珍,2008)。但是在中文的合同中,被 动式的效果却并不佳,相反的是主动式更受欢迎,因为主动式不仅能在语意 表达上能和被动式达到相同的效果,而且在形式上比被动语态更简洁。由此, 我们得到这样的启示,即在合同的汉英翻译时,应适当将汉语中的主动句翻 译为被动句。这里特别强调“适当”二字是因为万事皆有普遍性和特殊性, 翻译亦是如此,不论在英汉还是汉英翻译,译者在运用被动语态和主动语态 时都应考虑当时的语境,针对具体的情况进行具体地分析。

例 14 You may still request to cancel your Agreement, but you would only be released from the Agreement if a suit able replacement tenant can be found to take on your Room for the remainder of the Period of Residence.

初译:在此情况下,您仍可以请求取消协议,但您只有在居住期间找到合 适的替代租客后,协议方可被解除。

分析:例14中,被动式有两个,分别为“be released”和”be found”。”release” 一词的意为“释放”,它的被动则为“被释放”,但如果译者直接将其译为 “方可从协议中得到释放”则令人难以理解,不符合汉语逻辑。因此,在初 译中,笔者将“被释放”意译为“被解除”,这种译法虽然贴合原文,也没 有错误,但从法律翻译的目的性而言,这个翻译还可仔细推敲。因为英语不 同于汉语,英语注重形式,以句子结构、词语形式的变化来表达语义,而汉 语则以意会为主,注重语意和语境。汉语的动词一般同时具备主动和被动意 义,所以用主动就能表达出被动的含义,如汉语中经典俗语“海水不可斗量

(被人用斗量)”,这句俗语虽然没有用“被”字或者表示被动的词语,但 同样能达到被动式的效果。而且例14中的“解除” 一词与“斗量” 一样本 身也含有被动意义,所以笔者在这里采用“有被不用被”的方法,直接省略

“被”字,既符合中文的表达习惯,也符合法律语言严肃且严谨的风格。例 14中第二个被动式的处理方式与上例一样,将被动变为主动,强调动作实 施者“您”,弱化动作受施者“合适的替代租客”。这样的处理方式完全符 合汉语的表达习惯,因为汉语习惯将施事者放在主语的位置上,汉语大部分 句子的结构都是“某人做了某事”而非“某事为某人所做”,其实这也从一 定角度反映了汉民族特有的“以人为中心”的主体性思维方式。

改译:在此情况下,您仍可以请求取消协议,但您只有在居住期间找到合适 的替代租客后,协议方可解除。

通过上述两个例子,我们可以将法律英语中被动语态的翻译方法总结为 两种:一种是英语中的被动变为主动,即将原文中的主语变为汉语中的宾语, 将原文中的宾语变为汉语中的主语,或者增添主语;另一种翻译方法是将英 语中的被动保留,这种保留方式一般有直接省略“被”字,或者用其他带有 被动的含义的词语代替“被”字,如:“为……所”,“让”,“受”,“给” 等等。

虽然我们前面提到被动式在法律文本中得到广泛地应用,但是随着法律 翻译的不断发展,越来越多的专家反对在拟定法律条文时大量使用被动句, 因为这类句子没有人情味,而且常常表意不明,反而引起误会。所以,如前 所述,我们在合同的汉英翻译中,不得盲目运用大量被动语态来表达原文, 而要根据实际情况斟酌,选取最合适的语态进行翻译。

  • 长句的翻译

法律英语和法律汉语词语和句子的使用上有一定的差异,具体表现在, 法律汉语以短句居多,行文简洁,句子结构松散,但句子内部连贯,语义清 晰。而法律英语则表现为句子冗长,繁琐,但句法规范严谨,句子结构紧密, 层次分明。因此在翻译时,要充分考虑这两种该语言特征,在忠实于原文的 基础上适当调整语序,以实现译文的通顺连贯。在翻译法律英语长句时,我 们常用的两种方法有顺序译法和逆序译法。顺序译法,顾名思义,指的就按 照事件发生时间的顺序和逻辑顺序一一翻译,不做任何调整。而逆序译法则 是将语法位置置后的条件句、因果句或假设句中的条件、原因状语等先行翻 译,然后再按照汉语的逻辑顺序来表达原文的确切含义(李克兴、张新红, 2006: 564) o本次英文房屋租赁合同中就有大量长句,笔者在翻译时也采 用了上述两种方法,例如:

例 15 ®If you applied for accommodation as part of a group, or to live in an area with students on similar study courses ©we will endeavour to allocate similar students to any vacant rooms within the Accommodation but we can’t guarantee to do this and we have the right to allocate vacant rooms to students on different courses both prior to the commencement of this Agreement and during the Period of Residence.

译文:①如您以团体的名义申请住宿,或申请与课程相似的学生住在一起, ②我方会尽量将课程相似的学生分配到住宿内的空房间,③但我方不 能为此做任何保证,④因为我方有权在本协议生效之前和居住期间给 不同课程的学生分配房间。

分析:一般来说,大部分中文或英文的信息类文本都是按照时间顺序和逻辑 关系表达的,但是英文的句子长度相对而言更长,句子之间逻辑关系更精密, 这类句子经常出现在英文合同中,我们称之为简单长句。如例15,全句一 共有71个字,句子较长,但是句子的主干部分非常简单明了,句子的结构 为“If条件状语从句+Webutand…”从假设到结果到条件再到原因, 几个小句之间的逻辑结构非常清晰,而按照这个结构,我们将其翻译为中文 就是“如……我方会……但……因为……”。我们可以看出,英文的语序 与汉语完全一致,不需要进行语序调整,译文就能通顺精准地表达出原文的 含义,因此,根据法律翻译的标准中通顺这一原则,笔者应直接照搬原文① ②③④的顺序翻译,这样的话译文的准确性非常高,而且也符合中文的逻辑 结构和语言习惯。

由上文我们可知,法律翻译的第一要素是准确性,因此对于这种英文句 子与汉语句子语序完全一致的句子,译者需要做的是分析句子的成分,找到 句子的主干,然后按照原文的语序一一翻译即可,切不可随意调换语序,否 则会降低译文质量。

例 16 ① Any guarantee given by us to allocate any Accommodation to you shall cease to have effect @if this Agreement is terminated or suspended for any reason ® in accordance with the provisions of this Agreement.

译文:③按照本协议规定,②如本协议因任何原因终止或暂停,①我方提出 为您分配住宿的任何保证应不再有效。

分析:虽然上文中提到,中西方都习惯按照时间顺序叙述时间,按照逻辑关 系进行推理,但是这两种语言在表达习惯上还是有一定的差异。英文中,句 子的重心习惯放在句子开头,开门见山,而汉语中,句子重心则更喜欢放在 句子末尾。该特征表现在法律语言中则为,法律汉语中的状语总是位于句子 主体部分之前,而且汉语复句习惯先提条件或假设,再阐述相应的责任和结 果;法律英语中状语的位置不固定,可前可后,但更倾向于先陈述结果,再 说明原因或者提出条件。如上例,作者先陈述结果“Any guarantee given by us to allocate any Accommodation to you shall cease to have effect”, 然后再 说明产生这种结果的两个前提“if this Agreement is terminated or suspended for any reason “和”in accordance with the provisions of this Agreement”。因 此,在翻译时,译者充分考虑到了这类句式在英汉两种语言之间的差异,先 将句子的主句和从句切分,然后按照汉语语序排列,即先翻译出两个保证不 再有效的两个限定条件“按照本协议规定”和“如本协议因任何原因终止或 暂停”,再阐述结果“我方提出为您分配住宿的任何保证应不再有效”,这 样翻译,译文的语言才符合译语的逻辑,从而达到法律翻译标准中准确与通 顺的标准。

像上两例这样的句子原文中还有很多,大致的结构为“Y shall do, if X” 或“IfX,YwiUdo”,对于这两类含有条件状语从句的英文句子,不论其状 语从句是在主句前还是主句后,笔者都建议将其翻译为中文中的前置状语, 因为这样翻译会更符合上文中提到的中文句子重心习惯置于句尾的特点。

此外,笔者认为在任何一种文体的翻译中,不论长句还是短句,都应先 采取顺序译法试着翻译,这样才能最大程度地忠实于原文,但是这并不等于 完完全全按照原文一字不落地翻译,而是依据不同的情况适当地对句子中的 词语进行调整。只有在顺序译法行不通的情况下,为了保证译文具有可读性, 译者才可采取逆序译法或其他方法。同时,不论是采用顺序译法还是逆序译 法,译者都必须先分析原文的句子成分,然后再依据文本的特点选择适当的 翻译策略。

  • 翻译小结

在案例分析部分,笔者就翻译日志中记载的翻译难点进行了具体的分 析,并提出了自己的翻译策略。虽然上述翻译难点是基于本次翻译材料而提 出的,但其中大部分问题在其他的合同翻译中也会出现,而且,上文中笔者 提出的所有翻译策略与翻译方法都是在笔者准确理解原文,理清译文逻辑, 了解背景资料并反复斟酌之后给出的意见,因此具有一定普遍性和参考性。

 

5章实践总结

本次翻译实践报告以《约克大学住宿协议》为例,结合法律翻译的标准, 探讨了法律合同的翻译难点和解决策略,报告共分为五章,第一章为引言, 主要介绍了研究背景、研究内容和研究意义;第二章主要介绍了翻译项目的 内容、翻译要求和项目的现实意义;第三章主要描述了整个翻译过程,主要 包括译前、译中和译后三个阶段;第四章主要从词汇和句子两方面探讨了翻 译过程中的难点以及解决策略;第五章是对全文及两年翻译学习的总结。

通过此次翻译实践,笔者首先了解法律文本的文本特征,以及法律翻译 的标准,即准确、同一、通顺、和规范。在翻译过程中,笔者遇到了许多问 题,既有词汇层面的也有句子层面的,而为了解决这些问题,笔者查找了大 量资料包括电子数据库、期刊和词典,最后根据法律翻译的标准确定了最终 的译文,并对这些问题进行概括,写入论文中。在这一分析、总结和论文撰 写的过程中,笔者深刻认识到搜索能力与分析能力的重要性。

此外,在半年的实习过程中,笔者深刻体会到翻译不仅仅是两种语言之 间的转换,而是一种十分复杂的技术。而且,随着信息化进程逐步加快,译 者不应只具备语言和翻译能力,还应完全掌握以下几种能力:

第一,计算机基本技能。随着时代稳步发展,计算机技术的应用显然已 经成为各行各业人才的必备技能,当然也是现代翻译职业人才的必备素质 (王华树、王少爽,2016)。在翻译项目过程中译者有可能需要对文档格式 进行转换、词频统计、术语提取以及译后排版等,而这几种工作都要求译者 具备计算机基本技能。由此可见,掌握计算机基本技能可以在一定程度上提 高翻译工作的进度与翻译的质量。

第二,信息检索能力。如今我们处于大数据时代,几乎所有我们需要的 信息都能在互联网上找到,这对翻译这个行业而言无疑是个好消息。但是要 在茫茫网络中寻找到自己需要的信息并不是件简单的事情,由此译者的信息 检索能力则变得十分重要。所以,一名合格的译者必须要善于寻找资源,利 用资源,这样才能翻译出高质量的译文。

第三,CAT工具应用能力。随着信息时代的到来,现代翻译工作与传 统翻译工作有很大的差异。译者接到的往往是数量大、时间紧、任务急的稿 件,但是译者的效率毕竟有限,在此情况下,CAT工具运用能力也跃然成 为信息时代翻译工作者应具备的基本能力。

第四,术语能力。译者术语能力指的是译者能从事术语工作、利用术语 学理论和术语工具解决翻译工作中术语问题(王少爽,2011)。术语能力对 于翻译工作而言非常重要,尤其是在法律文本中,术语翻译的准确性直接决 定译文的准确性。

第五,译后编辑能力。如今机器翻译得到广泛地应用,译者的工作模式 从繁重的文字转换变为译后编辑。译后编辑能力的高低能直接影响翻译工作 的质量,因此,译者应当不断提高母语的语言能力,从而提高编辑能力。

以上几种能力都是信息化时代译者的必备技能,这几种能力之间是相互 依存,相互促进的关系。掌握了这几种技能,译者的工作效率才能得到大幅 度的提高,工作能力才能逐步加强。

All students should take advice, if necessary, before making a commitment. Do not accept an offer of Accommodation until you have read and are sure you understand the Agreement. The Agreement between us and you is regulated by English law which International students may find quite different to the law which applies in your own country.

These Terms and Conditions of Residence and the Accommodation Confirmation Letter contain certain words which have particular legal meanings. These words begin with capital letters so that you can immediately see them. There is a glossary at the end of these Terms and Conditions of Residence which explain the legal meaning of these words.

You must pay your Accommodation Fee on time and we expect you to look after your Accommodation. We want you to live in a peaceful neighbourhood free from anti-social behaviour and so we expect you to treat your Neighbours in the way you would like to be treated. The students living in the same Residence as you have the same rights and responsibilities as you. These are all reasonable expectations.

We are committed to managing the Accommodation in accordance with the best practice guidelines set out in the Code of Practice which can be reviewed at http://www.universitiesuk.ac.uk. If we fail to meet our responsibilities under this Agreement we expect you to tell us and give us the opportunity to put things right. If you fail to meet your responsibilities under the Agreement we will tell you and, unless the failure is serious or is persistent, we will give you a chance to put things right. If you fail to take this opportunity, or if the failure is serious or persistent, we will be entitled to take legal action against you which may result in you having to leave your Accommodation.

By Accepting this Agreement you enter into a legally binding contract with us which, for the Period of Residence and subject to the terms of this Agreement, gives you the

 

right to live in the Accommodation and to use the Communal Areas and the Residence Grounds provided that you pay the Accommodation Fee.

If you move into the Accommodation without having Accepted the Agreement you will be deemed as having Accepted the Agreement by your actions.

c) If the Agreement has been Accepted by someone appearing to act on your behalf we shall assume that you have given that person authority to act on your behalf and therefore to Accept and will regard that Acceptance as binding on you unless you have notified us previously to the contrary.

If you are under 18 at the time you Accept the Agreement, you may be asked to have a person over 18 years of age to join into the Agreement to guarantee your obligations. This is often a parent or guardian, but it does not have to be, as long as we are satisfied that it is an appropriate person. The Agreement will still be legally binding on you but, it will also be binding on the person standing as your guarantor – but only if you do not comply with your obligations.

e) If someone other than you pays all or part of the Accommodation Fee to us directly, whether they are a Sponsor or otherwise, this will not diminish or otherwise affect your responsibilities under the Agreement or give rise to any tenancy or other rights benefiting that third party. If the Sponsor does not pay the Accommodation Fee in full, the responsibility for the Accommodation Fee still remains with you and we may still 44

 

ask you to pay the Accommodation Fee. It will then be your responsibility to seek repayment of it from the Sponsor.

  1. Cancellation or deferral before Period of Residence 2.入住前取消或推迟

When you receive an Accommodation Confirmation Letter you will be given an Accommodation Confirmation Date by which to Accept and return the Agreement signed by You and all other relevant parties. If you do not return the signed Agreement by the Accommodation Confirmation Date, we reserve the right to cancel your Accommodation and allocate your Room to another Student.

  • If You subsequently inform us that You still wish to be allocated Accommodation You will be offered the next available Room which may not be to the same specification as the Room originally allocated and You are not guaranteed the same Room will be allocated or for the same Accommodation Fees. You will be required to enter into an Agreement in respect of the reallocated Accommodation.

If You decide not to Accept the new Accommodation and if you have already paid monies to us as set out in the Accommodation Confirmation Letter the Deposit of £250 will be repaid under the terms and conditions of the Tenancy Deposit Scheme. The balance of £750 is retained by us as the cancellation fee.

  • If you wish to cancel your Accommodation before you sign and return the Agreement, you will not incur any penalty fees. However, you must inform us in writing, via email, to accommodation@kaplan.com,for the request to be considered. If you remain studying at the International Pathways College or any other Kaplan college, any Accommodation Fees already paid in respect of the Accommodation will be reallocated against any outstanding tuition fees or other charges on your account or repaid to you where there are no other outstanding fees.

Cancellation after the Agreement has been signed and returned

  • Once you have signed and returned the Agreement, you have entered into a legally binding contract with us to move into the Room allocated to you and to pay all Accommodation Fees outlined in the Agreement.

  • If you wish to cancel your Agreement at any time after this point, either before or after you arrive and move in to the Room, you will be liable for the full Accommodation Fees. You may still request to cancel your Agreement, but you would only be released from the Agreement if a suitable replacement tenant can be found to take on your Room for the remainder of the Period of Residence.

  • If a suitable replacement tenant has been found and accepted and confirmed, and the new tenant has moved in to the Room then You, will be released from the Agreement. In this case, you will still be liable for the Accommodation Fees up to the date the new tenant moves in to the Room and you will also incur a £750 cancellation fee.

  • All requests for cancellation must be submitted in writing, via email, to

Pathways.comomative @kaplan.com for the request to be considered.

When You sign and return this Agreement you must pay the sum of £1000 (as set out in the Accommodation Confirmation Letter). This fee is made up of the Deposit of £250 and £750 by way of Advance Payment of the next instalment of the Accommodation Fees and which is deducted from that next instalment. If you cancel your Accommodation after signing and returning the Agreement, the Deposit of £250 will be repaid under the terms and conditions of the Tenancy Deposit Scheme. The balance of £750 is retained by us as the cancellation fee, as referred to above at clause 2 b) iii).

  • Cancellation due to Visa Refusal

If you fail to meet UK visa entry requirements and either You or we cancel your Accommodation as a result, the Deposit of £250 will be repaid under the terms and conditions of the Tenancy Deposit Scheme and any other amounts paid will be refunded on production of all of the following documents: (1) original visa refusal letter; (2) copy of the student’s passport showing both a photograph and a signature; and (3) where the payer was not the student, an original authority letter from the student authorising repayment to the payer, and only in accordance with other Kaplan terms and conditions agreed to upon accepting the offer to study at the College.

  • Cancellation due to deferral of Study

  • Where you have requested to defer your course of study (in accordance with the Kaplan International Pathways UK Terms and Conditions of Study) and this has been accepted, if You already have signed and returned an Agreement for Accommodation that Agreement will be cancelled (without penalty) and you will be required to sign a new Agreement. Any Accommodation Fees already paid will be applied to the new Period of Residence but You are not guaranteed the same Room will be available, and you may be subject to increased Accommodation Fees if the fees for that Accommodation for the later Period of Residence have increased.

  • If You reject the new Agreement where the alternative Accommodation offered does not meet the same specification as the original Accommodation or if there is no alternative Accommodation available for the deferred Period of Residence, we will refund any Accommodation Fees already paid, less the Deposit (if this has already been placed in to the Tenancy Deposit Scheme. In this case the Deposit will be refunded under the terms and conditions of the Tenancy Deposit Scheme).

  • If You are offered the same Accommodation for the deferred Period of Residence as was offered in the original Accommodation Confirmation Letter and you choose to reject the new agreement, we will retain the cancellation fee of £750 from any monies you have paid to us and the Deposit of £250 will be refunded under the terms and conditions of the Tenancy Deposit Scheme.

  • Cancellation by failure to move in

  • If you do not move into the Room within 7 days of the commencement of the Period of Residence and you have not contacted us to inform us that there will be a delay in your moving in or we have not agreed to hold the Room for the period of time you have requested, then we have the right to reallocate the Room and you will be liable for the Accommodation Fees up to the date we are able reallocate it.

  • If we are unable to reallocate the Room, however, you will be liable to pay for the Room or the full Period of Residence. We will make reasonable efforts to contact you regarding your failure to take up occupancy in the Accommodation before trying to reallocate the Accommodation.

  • Reallocation of Accommodation by us

We may give you notice to reallocate you to different suitable alternative accommodation after the date of this Agreement but before the date you take up residence in the Accommodation (if later) and if we do we will give you notice of the reallocated accommodation to which you will be moving into. For the avoidance of doubt any such reallocation of accommodation by us does not give you the right to cancel the Agreement.

  1. Guarantees of Accommodation

Any guarantee given by us to allocate any Accommodation to you shall cease to have effect if this Agreement is terminated or suspended for any reason in accordance with the provisions of this Agreement.

  1. University Staff

  1. Your Agreement is with us but we have an agreement with Kaplan who manage the allocation of Accommodation, the collection of the Accommodation Fee and the handling of the Deposit (referred to below in clause 6) on behalf of the University.

The Deposit is payable by you at the time of Accepting the Accommodation Confirmation Letter.

  • The Deposit will be protected under a Tenancy Deposit Scheme and will be transferred to it in accordance with the requirements of the Tenancy Deposit Scheme.

  • The Deposit may be used where you either are required to pay us any costs, fees or charges under this Agreement or where any Accommodation Fees are not paid. You will be advised via e-mail if a deduction is to be made from the Deposit at any time in accordance with the terms of this Agreement.

  • We shall be entitled to deduct and/or retain from the Deposit:

  1. any unpaid Accommodation Fee or other sums due under this Agreement;

  1. any reasonable sum we properly incur in rectifying any failure by you to comply with your obligations under this Agreement (including any damage to the Accommodation);

  • any reasonable removal and storage charges and/or disposal costs incurred by us in relation to items of property and belongings left by you in the Accommodation at the end of the Period of Residence;

  1. any charges reasonably incurred by us in relation to damage to any shared areas in the Accommodation or to any Communal Areas;

  1. (where the Agreement is terminated for any reason before the end of the Period of Residence) any Accommodation Fees which would have been payable on the instalment dates before the Termination Date; and

  1. any other charges payable by you under this Agreement where you are in breach of the Agreement and/or have caused damage, all such charges being stated in the list of charges on our website at:

  • Any charges deducted in accordance with clause 6 e) iv) above shall be deducted from the Deposits held for all Residents in equal amounts unless after reasonable investigation (where possible) liability can be linked to a particular resident. We may also deduct any administration costs we incur in investigating liability;

  • We will inform Kaplan when your Period of Residency has ended and they will inform the administrator of the Tenancy Deposit Scheme, together with details of the amount of the Deposit to be refunded to you and where to refund the money. The Tenancy Deposit Scheme administrator will then contact you and confirm all details before returning the amount to you directly within 30 working days of that confirmation.

  • Any dispute between you and Kaplan as to the amount of the Deposit to be refunded will be resolved in accordance with the Tenancy Deposit Scheme Regulations.

  1. Legally Binding Agreement

Do not sign this Agreement unless you intend to be legally bound by its terms. You have no right to cancel this agreement once you have signed it and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 do not apply to this Agreement. If there is anything you do not understand or wish to discuss, please contact Accommodation Services before signing this Agreement.

  1. Nature of Agreement

This Agreement takes effect as a licence and not an assured shorthold tenancy. This is because it is granted by an education institution so that you can pursue a course of study and also because we are entitled to relocate you in certain circumstances and to gain access to your Room at various times in accordance with the terms of this Agreement. This means that unlike private rented accommodation the Agreement does not have the legal protection set out in the Housing Act 1988, as amended, nor other legislation protecting residential tenancy agreements.

With the exception of any changes as a result of government legislation, this Agreement cannot be varied unless the variation has been agreed between you and us and the variation has been confirmed in writing by the Head of Space Management, Estates and Campus Services, Market Square, University of York, Vanbrugh Way, York, YO10 5DD.

  • We will comply with the Data Protection Act 1998 as amended from time to time. We will allow you to inspect certain information that we hold about you and you can ask us to correct or record your disagreement with the information we hold. We may charge you with the reasonable cost of providing copies of the information.

  • By Accepting this Agreement you agree that all data supplied to us can be shared with other departments within the University and to third parties if it is reasonable for us to do so as provider and manager of the Accommodation. Examples of third parties to whom we may need to make disclosure are organizations or individuals contracted by us to undertake services at the Residence, your Sponsor (if you have one), the police or other public agencies.

  • You agree to the University providing the Local Authority with a list of University properties and your name and University Accommodation address, for the purpose of supporting the process of student exemptions for Council Tax.

  • We only share sensitive personal information (for example, medical or disability related information) on a need to know basis where it is necessary for us to do so for your safety or wellbeing or the safety and wellbeing of others in the Residence. Please note, if you do not let us know in your application for Accommodation of any additional requirements you have for medical or disability related reasons, we may not be able to implement reasonable adjustments or provide auxiliary aids you inform us of your issues or needs at a later stage.

If any provision of this Agreement is held to be illegal, invalid or unenforceable, the legality, validity and enforceability of the remainder of this Agreement is to be unaffected.

  1. Legislation 立法 The Contracts (Rights of Third Parties) Act 1999 does not apply to this Agreement. This means that no one can enforce any rights or obligations under the Agreement other than you and us.

At the date of this Agreement the Accommodation Fee is exempt from VAT but we reserve the right to charge VAT if it becomes payable during the Period of Residence, for example, if there is a change in the law.

  3. During the Period of Residence we will provide the services and facilities set out below. Please note, from time to time, there may be problems with the services and facilities and we will endeavour to resolve these as soon as possible, once we are aware of the problem. However, we will not be liable (and you will therefore not be entitled to claim compensation), for any failure or interruption to any services or facilities, or for any loss arising from such failure or interruption, if the failure or interruption is due to reasons outside our control (unless the failure is caused by our negligence).

Reasons outside our control would include, for example, mechanical breakdown, failure, malfunction, shortages of fuel or materials or labour disputes, student action or from any necessary maintenance, repair, replacement, renewal, servicing, inspection or testing of the systems used to provide the services.

In addition, The University is a successful and growing institution and you should be aware that there is currently an exciting programme of development for new teaching and accommodation facilities on Campus. Details of the programme can be found on the University website at http:www.york.ac.uk/campus-investment/. From time to time, we may need to interrupt the services to the Accommodation and/or Residence in order to carry out these development works, but we will endeavour to cause as little disruption or disturbance to the Accommodation and your use of it as possible where we need to do so and will always give as much notice as we can of any such planned interruption (save in case of emergency). However, we will not be liable (and you will therefore not be entitled to claim compensation), for any such interruption to any services or facilities to the Accommodation and/or Residence, or for any loss arising from such interruption.

We will make sure that the structure and exterior of the Accommodation and the Residence are maintained. Whilst we endeavour to carry out maintenance work outside of the Period of Residence, we may need to carry out works at other times. If we do, we will endeavour to cause as little disturbance as possible but some disruption may be inevitable and we will not be liable to you for any such disruption.

  1. We will keep the Residence Grounds tidy and, as far as is reasonably practicable, free from waste or litter.

  1. We will keep the footpaths in the Residence Grounds in repair and, as far as is reasonably practicable, free from obstruction.

  1. We will provide kitchen, bathroom, toilet and shower facilities in the Residence and/or the Accommodation and make sure that they are kept repaired and in working order. Depending upon the type of the Accommodation, these facilities will be either shared with other students or ensuite. You are responsible for keeping these facilities clean, but we will help you keep communal bathrooms clean by providing a regular cleaning service.

In some Residences and/or Accommodation we will provide shared kitchen facilities. Where we do, we will provide and maintain in working order adequate facilities for the preparation, cooking and storage, including cold storage, of food.

  1. We will make sure all fixtures and fittings for water, gas, electricity, space and water heating in the Accommodation and the Residence are kept repaired and in working order.

  1. We will provide an adequate supply of hot water for domestic use.

  1. We will make sure that the fire-fighting equipment in any shared areas of the Accommodation, the Communal Areas or any other part of the Residence are kept repaired and in working order.

  1. We have arranged for an external company to provide and maintain facilities for the washing and drying of clothes in the Residence, for which there will be a separate charge levied by the external company at the point of use.

16.Insurance

  1. We will insure the Residence against fire and other risks which we reasonably consider necessary.

  1. At present, we provide a level of cover for your personal belongings under a block policy of insurance for all Residences, subject to the exclusions and limitations that apply to that policy. If you do not consider that cover is adequate then you can arrange for “top up” insurance but you will need to do this yourself directly with the insurance company. If for any reason we cease to provide the block policy (and we will give you notice of this if we do), you are responsible for taking out such insurance cover yourself at your own cost.

YOUR RESPONSIBILITIES

You must pay the Accommodation Fee during the Period of Residence on the following dates and in the following amounts:

  1. i) For students on a three term course, starting September 2018:

First Payment of £1,000 (£750 advance payment of the Accommodation Fee and £250 Deposit) before arrival when you confirm your Accommodation and return the signed Agreement;

Third payment for the final term of the Residence Period before the start of the second term, being 7th January 2019.

WHETHER OR NOT you move into the Accommodation; and

  • irrespective of the date that you actually move into the Accommodation (even if this is on a date later than the dates on which you are obliged to pay the Accommodation Fee);

  • For payments made under clause 17. a) you can do so by any of the Payment Methods, but for the payment to be made before you arrive, you are recommended to make your first payment by Flywire as this is the easiest and most reliable method for payments from overseas. Don’t forget to include your family name and student number (found on your course offer letter and on the Accommodation Confirmation Letter) as payment reference.

  • A copy of the bank receipt for your first payment should be included when you return the signed copy of this tenancy agreement to reserve your Accommodation.

  • When you arrive at the International Pathways College, you may pay any remaining Accommodation Fees by online payment, bank transfer, GBP cheque, credit or debit card. Credit or debit card payments shall be subject to the cardholder presenting photographic identification and may include a £30 administration fee.

As set out in clause 6, we may also deduct the administrative charge and/or any sum by way of outstanding Accommodation Fee from any Deposit we hold for you.

  1. Advance Payment

The Advance Payment shall be treated as follows: £750 shall be offset against the first instalment of the Accommodation Fee; and £250 shall be held as the Deposit for the performance of your obligations under this Agreement.

We will provide the Accommodation with such fixtures, fittings, furniture and equipment as detailed on the Inventory. You agree to complete and return the Inventory, within 48 hours of moving in, noting on the inventory any discrepancies. If there is any damage to the Accommodation, the Accommodation Contents or if there are any items missing at the end of the tenancy you may find it difficult to prove that you were not responsible, if you fail to report the problem at the start of the tenancy.

  1. Sharing the Accommodation

  1. Unless the Accommodation Confirmation Letter states otherwise, or we agree different arrangements with you in writing, only you can live in the Accommodation.

  1. If you applied for accommodation as part of a group, or to live in an area with students on similar study courses we will endeavour to allocate similar students to any vacant rooms within the Accommodation but we can’t guarantee to do this and we have the right to allocate vacant rooms to students on different courses both prior to the commencement of this Agreement and during the Period of Residence.

  1. You must not use the Accommodation for any other purpose than as study and living accommodation.

  1. You agree not to transfer your rights under this Agreement or sublet the Accommodation and you also agree not to allow any person to live in the Accommodation other than:

  1. the persons named in the Accommodation Confirmation Letter, or otherwise agreed with us in writing; or

  1. (in the case of a shared Room) with the student who has entered into a separate Accommodation Agreement with us in respect of the Room.

Any breach of these obligations will be regarded by us as a serious breach of this Agreement and may result in this Agreement being terminated early.

  1. Most Accommodation comprises single occupant Rooms, but if your Accommodation is designated as a shared Room and we have not agreed that you can live in it on your own, you will pay a reduced rent (as specified in the Accommodation Confirmation Letter) but we will be entitled to place another student in the Accommodation and you will be required to share the Accommodation with that student.

  1. our Accommodation is designated as a shared Room and the Student with whom you are sharing the Accommodation moves out of the Accommodation with our permission, then we will be entitled to place another student in the Accommodation with you.

  1. If you are in Accommodation designated as shared Room and it is under-occupied (and we haven’t agreed that you can live in it on your own) we can require you to move to a single room in accordance with the procedure in clause 33.

  • . Visitors and guests

If you agree to move to a single Room all the terms and conditions of this Agreement are transferable to the new Accommodation but you will no longer be entitled to pay a reduced Accommodation Fee and the Accommodation Fee will be for the full level detailed in the Accommodation Confirmation Letter for the alternative single Room.

  1. You are responsible for the behaviour of any invited guest (whether the invitation is made expressly by you or implied by your behaviour), in the Accommodation, the Residence, the Residence Grounds and the local neighbourhood surrounding the Residence and Residence Grounds.

  1. You are not allowed to give your keys to your guests and guests are not allowed to stay in the Accommodation without you being present.

  1. You must ensure that your guests do not break the terms of this Agreement. If they do, you may be held responsible for any damage, undue wear and tear, or disturbance caused and you and that person could face legal action. Also, it may result in this Agreement being terminated early.

You agree that we may remove or exclude your invited guests from the Accommodation or the Residence where we have reasonable grounds to believe that their exclusion is necessary for the safety and/or well being of other persons and/or to safeguard our property.

You agree not to allow anyone other than one occasional adult guest to stay overnight, for no more than two consecutive nights, provided this does not adversely affect other residents or disrupt study. We reserve the right to withdraw this privilege on 48 hours5 notice if in our reasonable opinion it is necessary to do so for the safety and wellbeing of other occupants of the Residence and/or to safeguard our property.

Unless you are asked to move by us, you must not to move to another Room within the Residence, or to any other accommodation provided by us, without first complying with the process for moving which is set out at http:www.york.ac.uk/about/departments/support-aiid-admin/accommodation/curreiitstudents/reques ttochangeleaveyourroom AND obtaining the prior written approval from the Ac commodation Services to this.

  2. the Accommodation Fee (which will be payable at the rate applicable to the new accommodation from the date you move into the new Accommodation (subject to clause 35.e));
  3. and any provisions which are specific to the original, or new, Accommodation.

You agree to comply and/or co-operate with a reasonable request by us to provide information or to assist in connection with a risk assessment undertaken by us in relation to your occupation of the Accommodation and/or the Residence.

You agree to have and to show respect for other persons living and/or working in the Residence at all times including (but not limited to):

  1. Not doing anything which causes or is likely to cause a nuisance or annoyance to your Neighbours;
  2. Not doing anything which interferes with the peace, comfort, or convenience of your Neighbours including (but not limited to) drunken behaviour, foul and/or abusive language and/or inconsiderate or inappropriate parking of vehicles;
  3. Keeping noise at a level that does not interfere with the study, sleep or comfort of our staff, contractors and your Neighbours. This includes any machinery, TVs, stereos, CD players, loudspeakers, musical instruments, etc. as well as being responsible for noise made by yourself or any of your guests. You agree to reduce the level of noise immediately if asked to do so by us. If you do not do so, it will be regarded as a serious breach of this Agreement.

In particular, you agree not to make or allow any loud noise:

  • between the hours of 23.00 hours and 08.00 hours each day; or
  • at all times in the week immediately before and throughout the period of any official University examination periods; or
  • during any other period when you have been notified by any member of staff that neighbouring residents are studying for an important examination or for a key submission deadline;

  • Not bringing into either the Accommodation, Residence and/or Residence Grounds any weapons or items of any description that are illegal or which we consider acting reasonably to be offensive or dangerous including (but not limited to) firearms, air-weapons, bows, knives, swords, martial arts weapons, paint ball guns and replica, ceremonial and toy weapons;

  • Not working on any motor vehicles or motor cycles in the Accommodation, the Residence or any of the Residence Grounds;

  • Not allowing the Accommodation to be used for any criminal, immoral or illegal purpose including, but not limited to, selling, supplying or using illegal substances, storing or handling stolen goods or prostitution. We consider that a breach of this clause is a serious breach of this Agreement and if you, someone living with you, or one of your invited guests, breaches this clause we may terminate this Agreement early;

Not allowing persistent use of Residence facilities by non-residents (e.g. it is not intended that your guests visit daily and use the Residence facilities for washing and cooking);

Not committing any criminal act or offence which we consider (acting reasonably) makes you unsuitable to continue to live in the Accommodation;

  1. Behaving with respect and consideration towards your Neighbours, our staff, our contractors and any invited guest or visitor. This includes not removing any articles from the Accommodation, Residence or Residence Grounds belonging to our staff or our contractors, not damaging the belongings of others, not taking or using other residents* possessions without permission and respecting the privacy of others;

  1. Not throwing anything from the windows of either the Accommodation or the Residence and not placing any item on the external window ledges of either the Accommodation or the Residence, for example bottles, cans, clothing etc.;

Not to bring a car to the University as:

  1. you are not eligible to apply for a college parking permit (except in exceptional circumstances or where a college has advertised parking provision within their college for some of their residents). A permit for a college does not allow use in other University car parks and;

  • You agree to keep the inside of the Accommodation in a clean and tidy condition at all times and to carry out your share of cleaning in any shared areas of the Accommodation. If you don’t and we have to carry out additional cleaning we will charge you for doing so.   • You agree to take reasonable care of all furniture and equipment provided by us in the Accommodation and detailed in the Inventory.

  • You agree not to remove, change, alter or damage (including damage caused by neglect or misuse) the decorative finish or any part of the Accommodation and/or Residence. This includes not putting up posters, hooks and other items with any type of fixing method or adhesive (including temporary adhesives such as Blu-Tack, sticky pads and sticky strips). You also agree not to make any holes in the furniture, fabric, walls and doors to accommodate the wiring of your electrical appliances or for any other purpose. If we have to do any work arising from a breach by you of this clause, we will charge you with the reasonable cost of that work and the administration fees in collecting the charge as set out at york.ac.uk/accommodation/currentstudents/residentshousekeeping/residentshandbook and this cost will be payable by you on demand or deducted from any Deposit.

  • You agree not to interfere with any fixtures, fittings, furniture or equipment, electrical, plumbing or telecommunications installation in the Accommodation, the Communal Areas any other part of the Residence or the Residence Ground s. If we have to do any work arising from a breach by you of this clause, we will charge you with the reasonable cost of that work and the administration fees in collecting the charge as set out at york.ac.uk/accommodation/currentstudents/residentshousekeeping/residentshandbook and this cost will be payabl e by you on demand or deducted from any Deposit.

  • You agree not to fit or install any satellite dish, television or radio aerial.

  • You agree not to bring any soft furnishings (save for bedding) or other furniture (including but not limited to inflatable furniture) into the Accommodation and/or the Residence except where the Accommodation Services has given prior written consent. All such furniture must comply with any relevant fire safety legislation and you will be required to remove (at your own expense) any furniture that you have brought on to the Accommodation without our permission and/or which does not comply with legislation;

If the repair is urgent, you should contact your College Reception. If you fail to report any loss, breakage, damage or repairs and that failure to report results in further loss or damage or failure to the Accommodation or the Residence then we can charge you for the costs we properly incur in repairing that additional damage or losses we incur.

It is your responsibility to help ensure that the Accommodation and the Residence is safe and secure to live in. This includes (but is not limited to) complying with the health and safety regulations which can be found at www.york.ac.uk/admin/hsas.

You must also comply with the following:

You agree:

  • to be responsible for ensuring that your own electrical equipment is safe to use and has been appropriately tested in line with University requirements. In particular, any item used in kitchens or other communal spaces must be PAT tested and then labelled.

We have the right to remove any appliance that has not been PAT tested. The University offers PAT testing sessions, so please ensure any item you wish to use in a communal space has been tested. This also includes extension leads and adaptors;

  • not to use cooking equipment, kettles, toasters, rice cookers or other similar electrical cooking in study bedrooms, unless your bedroom has a designated kitchen with cooking equipment provided by us, e.g. a studio flat. Where you place electrical cooking equipment in a shared kitchen for communal use it is your responsibility to ensure it is appropriately portable appliance tested in line with University requirements; and

You agree to adhere to all fire regulations and respond to fire alarms. The fire regulations can be found at http:www.york. ac.uk/admin/hsas/safetynet/Fire/fire safety.htm.

These regulations include (but are not limited to) the following obligations on you:

Failure to attend will result in a fine being payable by you in accordance with the schedule of fines and charges set out in the University Policy and Management Procedures – Fire Safety (Penalty Procedure) available on the website at http:york.ac.uk/admin/hsas/safetynet/Fire/fire safety.htm.

  1. you suspect that any item of safety equipment is defective or has been used, you will promptly report this to the Facilities Helpdesk;

  1. you agree not to obstruct Communal areas or fire escape routes nor prop open, or otherwise tamper with the fire doors as they are designed to reduce the spread of fire. All have door closers, which you agree not to impede or disconnect;

  • you agree not do anything which may cause a fire hazard, including (but not limited to) using or storing in the Accommodation or Residence any flammable materials including:

petrol, paraffin, bottled gas, oil (including oil-filled radiators) or other dangerous materials;

inflatable items (for example chairs, cushions etc);

deep fat fryer;

you agree that only curtains supplied by us can be hung at bedroom windows as they comply with British Standard Fire Safety regulations;

  • a single serious breach or repeated minor breaches of fire safety may result in us terminating your Agreement early;

  • Appropriate University staff carry out health & safety fire prevention checks in all Accommodation and Communal Areas and, if applicable, shared areas in your Accommodation including kitchens. Depending on your Residence you should expect to have checks anything from once a week to once a month;

You must ensure that your Accommodation and the Residence are left secure. This includes (but is not limited to):

  1. keeping your key, key fob or key card with you at all times. Persistent failure to carry your keys requiring you to be let in by our staff and/or our contractors may result in a charge being made to you by way of compensation for the time spent in letting you in to the Residence and/or the Accommodation. You will receive a written warning first before any charge is made;

  1. locking the door to your Accommodation and making sure all windows are locked whenever you leave it and ensure that any corridor and main entrance doors in the Residence are secure behind you when entering or leaving;

  1. not letting anyone you do not know into the Residence and accompanying your invited guests at all times;

You must allow our staff and/or contractors to enter the Accommodation in accordance with clause 32 below.

You must not keep any animal, bird, reptile, insect or fish at the Accommodation or in the Residence or within the Residence Grounds. Assistance dogs are permitted by prior arrangement with Accommodation Services.

  1. Payment for loss or damage

  1. You must pay for any or all loss or damage we suffer as a result of any breach of this Agreement by you, those living with you or your visitors. This includes (but is not limited to) any costs properly incurred by us in arranging any additional cleaning, key or lock replacement, collecting arrears, paying professional advisors and in relation to court proceedings.

Where any damage is caused to any shared areas in the Accommodation or the Communal Areas and those responsible cannot be identified (and we will use reasonable endeavours to identify them where the damage occurs during the Period of Residence), we may (acting reasonably) charge you a fair and reasonable proportion of the reasonable cost of making good any loss or damaged caused. Where the damage is discovered at the end of the Period of Residence and we cannot identify the person responsible the cost of repair and making good the damage will be divided equally between all former residents of the Accommodation at the date the Period of Residence came to an end.

In the event of any damage, which is caused either to your Accommodation or to any shared areas or Communal Areas as referred to in clauses a) and b), is not serious enough to require immediate repair or replacement and/or has the effect of reducing the period of time in which the damaged item would need to be replaced or redecorated, you will still be required to pay a fair charge towards the cost of repair or replacement or redecoration at a future date.   1. These charges are a guide for standard items. The charge could be higher or lower depending on a number of factors including, but not limited to, the charges incurred for labor and materials, administrative costs and managerial time.

This is a nominal amount only and you should be aware that this does not cover the full cost (including administrative expenses) to us of issuing a replacement set of keys/card. If a subsequent set of keys/card is lost/stolen the full cost of a replacement lock and keys necessary to ensure security for all may be charged.

If for any reason you cause us to become liable for Council Tax for the Accommodation (for example, because you are in full time employment or claim social security benefits) then you will repay to us within 14 days of written demand any sums paid by us to the local authority in respect of such Council Tax.

  1. We may charge you for any of the sums due from you under this clause 27 but we may choose to deduct these from any Deposit held by us in accordance with clause 4. We will notify you in both cases.

When you leave

At the end of the Agreement you agree:

  • to vacate the Accommodation by the time we have specified on either the last day of the Period of Residence or the last day of the Agreement, if ended earlier;

  • to return all keys, key fobs, or key cards to the College Reception. If keys, key fobs or key cards are not returned we will have to either fit new locks or replace the key fob or key card and we will charge you with the full cost of this;

  • to leave the Accommodation in a clean and tidy condition, having removed all your belongings and rubbish from the Accommodation, and to leave all items listed in the Inventory in the same condition as they were in at the start of the Period of Residence, except for fair wear and tear;

  • that if you leave any rubbish or belongings in the Accommodation, we can dispose of it/them. If you leave any belongings of value in the Accommodation or in any Communal Areas, then provided we know to which Resident they belong (or are likely to belong) we will notify you of this and give you a reasonable period of time to collect them. If you do not collect them within that reasonable period, you agree that we can dispose of them;

  • that if you do not comply with your obligations under clause iii) and as a result we have to clean or clear the Accommodation, we may charge you with the cost of this (including the administrative fees for collecting the charge as specified on the website at

www.york.ac.uk/accommodation/currentstudents/residentshousekeeping/residentshan dbook/). Where we have to do this in the Communal Areas, the cost of clearing and cleaning the Communal Areas will be charged equally between all residents of the Accommodation or Residence unless the person responsible for leaving the rubbish or belongings or leaving the kitchen in an unreasonable condition informs us they were responsible;

  • that if you do not leave the Accommodation by the time we have specified and we have to take action (which may include legal action) against you to require you to move out of the Accommodation you will pay all proper costs (including legal costs) that we incur together with all damage and loss we suffer (including, but not limited to, loss of income) as a result of you failing to leave;

Please note that you will be charged the Accommodation Fee for the period up to the date we receive that notice from you even if you have left the Accommodation before that date.

The University is a successful and growing institution and there is currently an exciting programme of development for new teaching and accommodation facilities on Campus. We will use reasonable endeavours to carry out any building works at

times likely to minimise disturbance to you but this may not always be possible and we do have the right to carry out any building works at the Accommodation, the Residence and/or on any other part of the Campus without liability for disturbance to you. Details of the planned development on Campus can be found on the University website at http:www.york.ac.uk/campus-investment/ which will be updated throughout the build period.

We have the right to enter the Accommodation to clean, inspect, repair, to show your room on Open Days and visit afternoons or for any other reasonable purpose at reasonable hours of the day.

  1. If we wish to exercise this right we will, whenever reasonably practical, give you at least 24 hours written notice (but whenever possible we will aim to give you 7 days1 notice) before entering the Accommodation. In that notice we will state the date (or where the visit may take place on one of a number of days, the range of dates) and purpose of the visit. Advance notice will not be given in the case of an emergency, in the case of ad-hoc statutory inspections or if you are in breach of clause 24 of this Agreement (Safety and Security) and have been informed in writing by us that inspections without notice are deemed necessary to protect your own well-being or the well-being and safety of others or to prevent damage to the Accommodation. In the case of an emergency, an ad-hoc statutory inspection, or a breach of clause 24, entry by us may be at any time without notice.

If you have reported to us the need for a repair in the Accommodation, we have the right to enter the Accommodation to inspect and/or undertake the repair at reasonable hours of the day without giving you advance notice of our visit. If when reporting the repair, you ask us to give you advance notice in accordance with clause 30(b) we will try to give that advance notice but may not be able to do so when we consider the repair requires prompt attention.

c)若您已向我方报告住宿需要维修,我方有权在未提前通知的情况下,在合理 时间内进入住宿检查或维修。若您在报修时要求我方按照第30 (b)条的规定提 前通知,我方会尽量提前通知,但若我方认为需要及时维修,可能无法提前通知。

  1. If you are not in the Accommodation when we call on a visit that we have either arranged in advance (in accordance with clause 30(b) ) or which arises as a result of you having reported a repair to us (in accordance with clause 30(c) )we may enter the Accommodation, using our duplicate key.

  1. In an emergency, where we cannot gain access, we may have to force entry. This might be, for example, where water is overflowing or somebody’s life or physical safety is at risk. In this case, we will secure the Accommodation and repair any damage as a result of the forced entry. If we have to force entry because of your neglect or misuse of the Accommodation or your failure to report repairs, we will charge you with the reasonable cost of having to force entry and repairing any associated damage;

If we incur costs when calling on a pre-arranged visit because access is refused or we cannot enter the Accommodation in accordance with clause 30(e) (because you have given us specific instruction ns to the contrary and you are not in when we visit), we will charge you with the cost of this (as set out in our list of standard charges at:

If we have to take legal action to enforce the right of entry we will ask the court for an order for the cost of the legal action to be paid by you.

  1. Where, on any inspection of the Accommodation by us under this clause 30, we reasonably consider that additional cleaning is required, we will first issue you with a warning. If the Accommodation is not cleaned to a satisfactory condition by the time of the next inspection we may arrange for any necessary work to be undertaken and may charge you for the cost of us undertaking the cleaning ourselves which will increase the administrative charges we incur in arranging any such cleaning.   1. We provide a regular kitchen cleaning service for communal kitchens. We let you know the day we clean the kitchen and what you need to do in preparation for this cleaning service. If your kitchen has not been fully prepared, a partial clean or no cleaning will be carried out and you will be informed that we may not clean and may charge if the kitchen is not fully prepared at the next scheduled clean. Any charge for failure to clean will be charged to all residents assigned to the kitchen because this is a communal responsibility.

We confirm to you that when exercising any of our rights to inspect, enter, repair or otherwise manage the Accommodation and the Residence in accordance with the terms of this Agreement we will do so in accordance with our obligations and duties to you under any relevant safeguarding laws and regulations applicable under English Law.

  1. Removal of items from Accommodation

We may remove from the Accommodation any items which we find in the Accommodation or Residence (either used or unused) that we consider are dangerous and/or may cause a fire hazard. If we remove an item, we will inform you that the item has been confiscated and who you need to contact in order to recover the item. You will not be able, however, to take the item back into the Accommodation.

我方可能会没收从住宿中找到的任何我方认为危险或可能引起火灾的物品(不论 您是否使用过)。若该物品被没收,我方会通知您并告诉您联系何人才能取回该 物品,但是您不能将该物品再带回住宿。

  1. Liability for loss or damage

Subject to the provisions of the Occupiers Liability Act 1957 and the Defective Premises Act 1972, we shall not in any circumstances incur any liability in respect of loss or damage to any person or property or otherwise, unless the loss or damage was caused by our negligence.

  1. Right to relocate

We reserve the right to move you to similar alternative accommodation for reasonable management reasons including (but not limited to):

  1. where we consider that we cannot reasonably carry out works to the Accommodation, the Residence or neighbouring property (whether repairs or improvements) whilst you, and anyone living with you, remain in the Accommodation;

  1. where the Accommodation and/or the Residence is damaged or otherwise adversely affected, such that we reasonably consider that it is unfit for occupation (for example, due to flood, infestation, storm, damage, plant malfunction);

  • where your Period of Residence includes the Christmas and/or Easter and/or Summer vacations and the Residence is not fully occupied over the vacation and we reasonably decide to move you to other University accommodation so that all students residing in the University over the vacation are together in the same part of the University;

  1. where the terms of your Agreement, due to the nature of your course of study or otherwise, are inconsistent with the terms of the standard Agreement (for example the Agreement incorporates a late start, early finish or short Period of Residence);

  1. where we ask you to move under Clause 2O.h); or

  1. where we need to relocate another resident to your Accommodation because your Accommodation is more suitable for them (for reasons of health, welfare or mobility) and no other suitable accommodation for that resident is otherwise available.

  1. We reserve the right to require you to move (either temporarily or permanently) to suitable alternative accommodation where we reasonably consider, because of your behavior, or for your welfare or for any other reason, that it is necessary to move you from the Accommodation to protect your well-being or the well-being of others or to prevent damage to the Accommodation. Failure by you to comply with this clause by refusing to vacate will be considered a serious breach of this Agreement.

  1. If we request you to relocate:
  2. We will give you written notice of this and give you details of the suitable alternative accommodation to which you will be moving. We will also notify you of the date on which you are to move to the suitable alternative accommodation and we will give you reasonable notice of this date (taking into account the circumstances). Certain circumstances may mean that the notice period may be as little as twenty four hours;

c)如果我方要求您搬迁:

  • subject to clause 35(e), if the Accommodation Fee for the suitable alternative accommodation is less than the Accommodation Fee that you are paying, we will charge you the lower Accommodation Fee as from the date on which you move into the suitable alternative accommodation; and

  1. if we reasonably agree that the alternative accommodation is not sufficiently similar, you have the right to terminate this Agreement. If you wish to exercise this right you must give Accommodation Services written notice of this no later than 7 days after the date of the written notice that we have given to you under clause 35 (c)(i). The Agreement will then end on a date 7 days after your notice to terminate was given to accommodation Services or such other date as you may agree with Accommodation Services (acting reasonably). We will refund any Accommodation Fee you have paid in respect of the period after the termination date.

  1. If you do not move out of the Accommodation when we you to do so, we can take legal action to force you to move out. If we have to take legal action, we will ask the court for an order that the cost of the legal action be paid by you.

  1. If you are moving from catered accommodation to non-catered accommodation, unless we in our absolute discretion agree to waive such requirement, you will pay the catered accommodation fee for all meals you have been entitled to take for your catered Accommodation during the Residence Period up to and including the Friday dinner of the week of the relocation, and you will also be entitled to redeem all meals paid for (in the outlet allocated to you under the catered accommodation package).

  1. Right to temporarily suspend your right to occupy

If you have:

  1. committed a serious breach of your obligations under this Agreement, or we reasonably suspect that you have; or
  2. you are in serious breach of the University Regulations such that we reasonably consider that suspension from your Accommodation is necessary; or
  • you are under investigation by the police for any offence or are charged with any offence; or

a)如果您:

ii)严重违反了大学校规,因此我方合理地认为有必要取消您的住宿;或

  1. we have reasonable grounds to believe that you may have committed any offence (whether or not at that stage there is any police investigation) we may suspend you from the Accommodation during the period of appropriate investigation of the breach or the suspected breach or the offence or suspected offence. We will only suspend you if we consider (acting reasonably) that your continued presence at the Accommodation will constitute a threat to life, limb or safety or well-being of any person and/or criminal damage to property. Any decision to suspend you will be made in accordance with the procedure set out in the Regulations and be subject to your right to appeal that suspension as detailed in the Regulations. During this suspension, we are under no obligation to provide you with any accommodation.

PROCEDURE FOR DEALING WITH YOUR BREACHES

If you, anyone living with you or your invited guests breach any of the conditions of this Agreement then, depending upon the nature of the breach and/or the seriousness of the breach, action may be taken against you under the procedure set out in clauses c) to h) below.

  • Save for the breaches set out below, any breach of the conditions of this Agreement by you, or by anyone living with you or by your invited guests, will constitute a disciplinary offence under the Regulations. Those breaches that will not constitute a disciplinary offence are:
  • failure to pay the Accommodation Fee; and/or
  • you being made bankrupt.

b)若您本人、室友与访客违反本协议任何条款,都将视作违反《住宿条例》, 但以下行为除外:

i)未缴纳住宿费;或 ii)破产。

  • On any member of staff of the University identifying or becoming aware of any breach or suspected breach by you of the terms of this Agreement, that member of staff will decide (subject to clause d)) whether to:

take no action; or

discuss this with you informally; and/or

refer the matter to Accommodation Services and/or; and/or

refer the matter to the Head of College for the Residence.

  • The matter will be referred to Accommodation Services and/or Health & Safety in circumstances where:
  • it is clear that you, anyone living with you or your invited guests have breached the Agreement; and
  • that the breach has resulted in damage being caused to the Accommodation, the Residence or the Residence Grounds.

  • If the matter is referred to Accommodation Services under clause d):
  1. you will be issued with a demand for the reasonable cost of repairing the damage caused by your breach in accordance with clause 29. You will need to pay the invoice within 14 days and if you fail to do so this will constitute a disciplinary offence under Regulation 7 and the matter will be referred to the Head of College of the Residence to be dealt with in accordance with clause 37(f) and Regulation 7. If you are unhappy with the amount of the invoice issued to you by Accommodation Services, you can complain about the level of the invoice in accordance with the procedure set out in clause 42;
  2. where the matter is sufficiently serious, it shall be referred to the Head of College for the Residence.

e)若根据条款d)将此事上报住宿服务部:

  • If the breach or suspected breach is referred to the Head of College for the Residence, the Head of College will deal with the breach or suspected breach in accordance with Regulation 7 of the Regulations. If the Head of College decides that you have committed the breach then, under Regulation 7, this could result in the Head of College:
  1. imposing a fine up to the maximum figure as set out in Regulation 7; and/or
  2. requiring you to pay the reasonable costs incurred by us arising from the breach over and above any payable by you under clause e); and/or
  • referring the matter to the Deputy Vice Chancellor or a Pro Vice Chancellor. This may result in a decision being made that we will terminate this Agreement;

f)若违规或涉嫌违规行为上报学院院长,学院院长将根据《住宿条例》第7条 处理违规行为或涉嫌违规行为。若学院院长认为违规行为属实,依据本协议第7 条,院长可能:

  • If you are unhappy with the decision made by the Head of College, you can complain about the decision in accordance with the procedure set out in clause 42. If you are unhappy with the decision made by the Deputy Vice Chancellor or a Pro Vice Chancellor, you may appeal this decision following the procedure in University Regulation 7. University Regulations are on the web page http :york.ac.uk/about/organisation/govemance/govemance-documents/ordinan ces-and-regulations/regulation-7/

  • The above procedure will not apply in relation to a breach of the Agreement arising from either your failure to pay the Accommodation Fee in accordance with the payment terms or you becoming bankrupt. In such circumstances:
  • we will be entitled to terminate the Agreement in accordance with clause 39;
  • ) if you are unhappy with the decision you can complain about the decision in accordance with the procedure set out in clause 44.

As such, if you are experiencing any financial difficulties which may mean that you are unable to pay the Accommodation Fee when it is due you should immediately contact the Fees Office.

If you find a suitable replacement occupier who is not already in accommodation provided by us and who will occupy the Accommodation immediately after you have left you may request to terminate this Agreement by submitting details of the replacement occupier to Accommodation Services and to Kaplan for approval. Accommodation Services and Kaplan are not obliged to accept a request from you but will give reasonable consideration to a termination request in these circumstances, but for example, it shall be reasonable for them not to approve a request where the alternative occupier you propose to take your Room is not deemed suitable by both Accommodation Services and the International Pathways College taking into consideration the type of student residents within the Accommodation as well as the suitability of the proposed replacement occupier.

  1. Termination for breach

We may terminate this Agreement in any of the following circumstances:

If you have failed to pay the Accommodation Fee or any other sum due to us under this Agreement; or

  1. where you have committed a serious breach or have persistently breached the conditions of this Agreement and, having followed the procedure set out at clause 37 above, we have decided to terminate the Agreement; or
  2. if you are made bankrupt.

We may also terminate this Agreement by giving you notice in any of the following circumstances:

If we are unable to find you similar alternative accommodation (despite our reasonable efforts) and, through no fault of your own, either:

your Accommodation has been severely damaged and, acting reasonably, we deem it unfit for occupation; or

we are unable to provide the Accommodation as a result of events beyond our control;

If you are no longer pursuing a full-time course of study at the University whether because you have chosen not to or because you are in breach of the terms of your study contract;

Where we reasonably consider that, because:

of your behavior; or

of any other reason (for example, an infestation by insects or an outbreak of an infectious disease)

it is necessary to move you from the Accommodation to protect your well-being or the well-being of others, or to prevent damage to the Accommodation;

  1. If any information supplied by you, or on your behalf, in connection with your application to the University or for a place in the Accommodation is untrue, inaccurate or misleading, or if you fail to disclose relevant information which would amount to a misrepresentation, and we consider (acting reasonably) that the relevant information makes you unsuitable to live in the Accommodation; or

  1. If for any reason you cause us to become liable for Council Tax (because you or any other occupier are in full time employment or claim social security benefits) for the Residence.

  1. a) If we terminate the Agreement under clauses 39 and 40 we will give you reasonable notice (taking into account the circumstances) that we are terminating the Agreement. The notice period will not normally be less than four weeks but may be as little as twenty-four hours.

The termination of the Agreement will not affect our rights to claim against you for any loss or damage caused by any breach of the Agreement by you, anyone authorised by us to live with you and/or your invited guests.

If the Agreement is terminated and you do not move out of the Accommodation by the termination date, we will only be able to force you to move out if we obtain a court order. You will be obliged to pay our proper costs (including legal costs) that we incur in taking such action and we will ask the court to make an order requiring you to pay these costs.

c)若本协议终止且您未在终止日期前搬离住宿,我方将只能在获得法律授权后 强行让您搬离。您将有义务支付我方采取此类行动所产生的费用(包括法律费 用),我方将向法院申请有您支付相关费用。

  1. If the Agreement is terminated in the circumstances set out in clause 4O.a) and you have moved out of the Accommodation by the termination date:
  2. you will still be obliged to pay, to the extent you have not already paid, that part of the Accommodation Fee corresponding to the period up to and including the termination date; but
  3. we will refund any Accommodation Fee you have paid in advance, in respect of the period after the termination date.

d)若本协议已根据第4O.a)条规定终止且您已在终止日期之前离开住宿:

i)若您尚未支付全部住宿费,您仍有义务支付在截止日期(包括终止日期)之 前未支付的部分住宿费;但

  1. If we terminate the Agreement in the circumstances set out in clauses 39, 4O.b), 4O.c).i), 4O.d) or 4O.e):

  • you will still be obliged to pay, to the extent you have not already paid, that instalment (or instalments) of the Accommodation Fee that should have been paid before the Agreement was terminated, even if that sum covers a period which extends beyond the termination date (where you are paying by instalments this would include all instalments where the date on which the instalment was due to be paid was before the date the Agreement was terminated; but

If you are unhappy with a decision that we have made or feel we have either not kept to the terms of this Agreement or that we have breached the Code of Practice you should, in the first instance, follow the Accommodation Services complaints procedure which you can view at:

  • For the avoidance of doubt, if we have decided, in accordance with the provisions of this Agreement, to terminate this Agreement we will be entitled to take legal action against you to recover possession of the Accommodation notwithstanding that you may have complained about our decision to terminate the Agreement.

  1. All letters and notices sent by us to you will be properly served if they are given to you in person or by e-mail to your University address or if they are delivered by hand, by first class post, or by special delivery to you at:
  2. the Accommodation and/or;
  3. the address you provide to us when applying to us for the Accommodation or such other address that you have notified us of in accordance with clause 42.

A notice sent by the following means is to be treated as having been received;

if delivered by hand, on the day of delivery; or

if sent by special or recorded delivery, on the first working day after posting; or

if sent by first class post, on the second working day after posting; or if sent by email to your University address and no “delivery failure” message is received.

Any notices about the Accommodation or this Agreement (including notices in proceedings) which you want to send to us should be sent to Accommodation Services.
